TX Concealed Weapon Law

I was told today by a DPS officer that it is now legal to carry a pistol under the seat of your auto even without a concealed weapon license. Truth or not, anyone know about a change in the law last Sept??

I am just liberal about things that effect others, not me. Really was surprized because the license was supposed to stop people riding around with weapons in their vehicle.

Don't qoate me on it cuz your the lawyer but...... In the past anyone could carry a weapon if they were "traveling". The legislature and courts never really set a standard as to what travelling was. As a rule of thumb a person had to be going through 3 counties and staying overnight at the new destination. Once you arrived it was no longer legal to carry the firearm. The way I understand it, and I could be wrong, is that the legislature removed the travelling section. This took effect about the same time I quit being a cop so I never went to the law updates class. My cousin is a State Trooper and explained it to me the way I described to you. He basiclly said to keep it hidden and don't worry about it. If your doing wrong it'll cost ya, if your doing right you have nothing to worry about. Take it with a grain of salt.

It always has been legal... it's HOW it's carried that matters.

The standard is "two motions to make the gun ready" are required to avoid the concealed requirement.

In your dash, in a holster is legal. (open glove box is one, remove from holster is two).

Under your seat, in a holster, in a small plastic case is legal. (open plastic case one, remove from holster two).

in Massachusetts, the LIBERAL STATE, we can conceal that weapon any place on your body, in a car, house, hen coop etc:any time as long as you have a pistol permit and can carry a weapon which holds large capacity rounds, anything that holds over ten rounds is considered large compacity!!!!!

It confirms that IF you can legally possess a firearm, and are traveling, you can carry it inside your vehicle. The firearm can be loaded and MUST be concealed. If it is in view, it is in violation of the law.

Many thanks, thought my concealed weapon license was important but finding maybe not so. I will check it out further.

A few years ago a local citizen (local to DFW) was on his way to the firing range and observed an altercation in a parking lot. Some dude shot his woman, jumped in his truck and started to drive away.

Local citizen stopped, got out his scoped SS Super Blackhawk and blew the bad guy away as he drove past.

Armed citizens one, bad guys zero. No charges filed.

That event may have influenced the change in Texas law.

It's not quite as easy as all that in Massachusetts.

You can't carry concealed away from your domicile unless you hold a Class A (a.k.a. "high cap") permit issued for "protection of life and property" or "all lawful purposes". A "hunting & target practice" issue does not allow you to carry concealed. Even with the correct permit, the concealed firearm must also be loaded with a round chambered to technically comply with the law.

Leaving a firearm concealed in an unattended vehicle is a misdemeanor punishable by fine, it is also sufficient cause for your permit to get revoked.

Does that mean I couldn't leave my gun in my car under my jacket when I stop for a case of beer on the way the range?

If I was a legal firearm carrier in Massachuttes (sp) what am I suposed to do with my legal firearm while entering a courthouse? Leave it in my car illegally or give it to a junkie to hold for me till I get out? I guess I coul do what the ainti gunners want me to and shove it up my arse. Some laws are so stupid it hurts.

A lot of states (I don't know about Mass.) have exceptions to the open carry law that state you can not take a gun into a couthouse or a bank. FWIW, shopping malls are okay.

Just my political opinion for this month.

Stupid laws are nothing new when it comes to Massachusetts. :'( It's a pretty good example of how bad things can get when the inmates run the asylum.

Seriously, they make provision that you can check your firearm before going through the metal detector, although I wouldn't trust them to take care of it properly while I was inside.

About the only other no-nos that I can recall off the top of my head are CCW on school grounds, in bars, and any business that has clearly posted signs expressly prohibiting CCW on the premises.

In NY you can leave your pistol locked in the trunk of a car. I drive a pickup so I can't legally leave my gun in it when I go into a place that is illegal to carry. Sort of a catch 22 similar to Mass.

Don't forget in Mass you have to bring your shot gun to church with you. Its the law!
