Francisco Javier Dominguez-Rivera, 22, of Puebla, Mexico, was killed Friday in a confrontation with the unidentified agent north of the U.S.-Mexico border in Arizona between Bisbee and Douglas.

A group of seven people were crossing the desert and the agent took six of them into custody without incident, authorities said.

But the agent and Dominguez-Rivera began fighting, authorities said. The agent, who believed his life was in danger, shot and killed the man, the Border Patrol said previously. An autopsy was scheduled Wednesday.

Two Texas Border Patrol agents convicted of shooting a Mexican drug runner in the backside while on duty turned themselves in to U.S. Marshals Wednesday.

In exchange for his testimony against the two agents, Davila was granted immunity from prosecution by the U.S. government for attempting to smuggle nearly 750 pounds of marijuana, which had a street value of more than $1 million, into the United States on the day he was shot. He was treated in a U.S. hospital and is now suing the federal government for $5 million, Poe said.


Ignacio Ramos and Jose Alonso Compean began serving 11- and 12-year prison sentences, respectively, for the February 2005 non-fatal shooting of Osvaldo Aldrete Davila.

It would have been more professional to word it;
Dominguez-Rivera allegedly was shot and killed while resisting arrest.

Compean and Ramos were convicted by a jury last March of violating the civil rights of Davila when they shot him on Feb. 17, 2005, in Fabens, Texas, about 30 miles east of El Paso, then tampering with evidence by picking up shell casings from the shooting.

That report also spins.
They picked up their shell casings and violated common standard law enforcement proceedures by not reporting discharging their firearms in the line of duty.

When law enforcement violates the law, proceedures and tamper with evidence they should get time.

Skinny seems more concerned about the shell casings then about the real problem here-

Probably some liberal judge and a bunch of willys on the jury. If I didn't know better I would think this was being tried in San Francisco.

What jury, rubberfrog? Jury's don't grant immunity from prosecution - if a jury is deciding it, the prosecution is already in progress. Federal prosecutors, appointed by the president, grant immunity.

I guess I need an education on federal prosecutors, the President of the United States appoints them? Are there no Congresioanl hearings for them being appointed? Please enlighten me J.

Didn't you get the essence? The guy is exempt from prosecution, he is suing for 5 million bucks, and he had 750 lbs of smoke on him when he crossed the border... do we have to debate the meaning of is again? Or are you just playing stupid for laughs?

It sucks that he's exempt and it's silly that he's suing. Was I time I'd a been bummed about the smoke not reaching its destination but that's a long time ago.

R/F blamed judge and jury, I guess it was just a friendly dig at willyb, but that's where my comment was aimed - surprised I have to explain this to ya. 8)

[btw eric, here's what I know: there's a fed prosecutor for each fed judicial district - pres appoints the prosecutors same as judges, don't know if it's a bulk thing all at once or just as needed, don't know abou congressional oversight, don't know who appointed this 'un, dont' really care. I don't know what kind of LEO the guy was either, could have been one a those low down sumbioches who gives a bad name to Law Enforcement for all I know - I hope so considering what all 'we the people' gave up to get him busted - or he coulda just been an unlucky sumbioch caught up in some kinda personal career enhancement action of a bad fed.]

I never could understand that. Gee, do you think the bullet holes may be a clue as to the cause of death?

We are hell bent, in this country, to pander to those who break the law simply by stepping across the border. I guess the drugs were just a minor little detail that can be negotiated away.

See what happens when an American walks across the border into Mexico (Illegally/unnanounced) and meets up with the "Federalis"? They'll rot in a Mexican jail for years as the Mexican government pontificates and employs every stall tactic in the book.

I could tell them that.

I wasn't there, you weren't there. So we'll prosecute the person in which it is easy and politically correct to do so.

Political correctness and facts have no relation to each other.

Let's just disarm the Border Patrol and give them counters so at least we have a semi accurate number of illegals and drugs (give them scales too) crossing.

If we taxed the drugs, it could be self funding.

If a cop OFF the border covered up a shooting everbody would be ok with it

Leaving out the prior convictions...looks more like a spin job to me...than including them.

Not clear on what you're saying here...I wasn't there, you weren't either, so using science to help sort out the facts is somehow related to political correctness?

Autopsy is done to try and determine fact...far as I know, you can't determine a person's politics by doing an autopsy. And bullet holes prove he was shot, but don't prove he was shot to death. If you can convince me that the total number of bad cops in America is zero, and that you can guarantee it'll always be zero, I'll agree with you that LEO firearm discharges need not be investigated.
