Intervention ????

My favorite brother in law (BIL) has a friend that we know has had a stroke. No short term memory at all. Hasn't had a beer in 6 weeks (daily drinking is normal to him), not smoking (after 40 some years), not eating well, not taking care of his animals (he called them is kids), and not keeping up with his hygiene as he did.

He has a roommate that maybe taking advantage of his condition. He was a lotto winner and gets a modest paycheck twice a year. He doesn't work and doesn't have any insurance.

The main problem is that he feels there is NO problem. With this, nobody can get him to go to the hospital. We are afraid that time is running out for him. My niece (BIL's daughter) is a paramedic and says that with Ohio law, nobody can force him to get treatment. I think there has to be some way for it to happen. My BIL is really shook up over this. Its the same one that his girl friend ripped him off of his savings and then committed suicide. So this has him worried big time.

Any ideas?

Re: Intervention ????

Does he have any family that can be contacted?
Maybe a call to police, lawyer or DA to discuss options?

We checked with the local authorities, and they say until he is able to say he wants treated, nothing from their side can be done.

His mother and sister have been doing their best to get him to go, but he insists that he is okay. He can't remember how to get anywhere, but he knows how to drive. Can't remember his friends names, but knows their faces.

I've heard of situations like this and they only have nothing but bad things to come. My BIL and his friend is both in their mid 60's and grew up together. They have had many great times together and this is what makes it so hard to see this happening.

I think the mother or sister can go to court and petition to become his gaurdian
because he is imcopatent.
to take care of him self.
maybe check with family services

Re: Intervention ????

unfortunately, the family and friends are going to have to petition the court, to have him declared incompetent, to handle his daily affairs, and have a person appointed to handle his financial situation.

in FL, there is what is called the Baker Act, it allows families and friends to have the person, committed for 3 days for an in-house assessment, to determine there capability, to make decisions. on recommendations of the facility, the court will determine, whether the individual is released, or held for further treatment and assessment.

Legal Aid, Family services, Senior Services, Public health.

Sorry I don't have any advice but if anything like this were to happen to me, I would hope to have a friend like your BIL. Maybe your BIL could use a "pat on the back" to let him know he's a great friend.

As sad as it is, I would agree the court needs to be petitioned to determine his competency. It definately will make for an awkward Thanksgiving dinner.

Try placing a call to Adult protective services. They are like child protective services. They can stop buy and do an assessment visit. Your involvement will remain anonymous. Doug

Re: Intervention ????

Here in WV the county in which I work as a Paramedic a Family member can petition the court for a mental hygiene petition. With the petition signed by the commissioner, the Sheriffs dept. can pick the person up and take them for a mental and or medical evaluation.

A decision is then made about the person?s competency, if the powers to be decide the person is incapable of making sound decisions. They can then force the person to get treatment.

Jeff.

Re: Intervention ????

Thanks for the info. Passed on the ideas to my BIL. Seems as if his friend has now dropped about 40 pounds. He was only about 160 to begin with. Its sad to realize, he may never be himself again.

Elliot is his name, maybe some prayer will help.........Thanks A bunch....SS

Re: Intervention ????

not sure if this would work. In pa, he would be a "302" (involuntary 72 hr commital) if you could show he'sd a danger to himself or others. can be extended to i think 30 days? you folks may have a silmilar law
