Did anybody else receive a mailing about a legal settlement with several manufacturers? I received 2 stating that if I supply my model#, serial# for the lawn mower and the engine I would receive up to $75 for a rider and $35 for a walk-behind.
The settlement is supposed be because just about every model had overstated the HP rating covering models purchased between 01/01/1994 and 04/12/2010.
A partial list of manufacturers is Yard-Man, Cub Cadet, Honda, Bolens, Exmark, John Deere, Sabre, Scotts, etc.

Okay, a lawsuit over the "advertised" horsepower of lawn mowers??? This is a Sign of the Apocalypse, for sure!

Wow, I was wondering why my 6HP Honda was operating more like a 5.5.

Just bought a Honda-engine'd walk-behind last weekend from Sears. The salesman used 10,000 words talking about torque and dyno numbers, and was very careful to avoid the word "horsepower." I thought that was kinda curious, but I guess now I know why.

Wow, maybe I can get me $75 to use for 3 gallons of gas this summer :rolleyes:

My FIL got one last week. I bought a new rider one year before him and a year after I have received nothing. I checked the list and my makes are on it. Oh well. Maybe that $150.00 I don't get will help offset the soon to be increased price for the next one I buy.:rolleyes:

Personally, I don't care if my 25hp Kohler is actually 23 or if my 27hp Kawasaki is really only 25.5. Now, when they quite running, I will care.

Yeah, I got one and did not realize it was for over-rating hp....If it is, I agree with it....I bought a John Deere JS60H high-wheeled push mower with a 6.5 B&S motor about 10 years ago. It didn' cut as well as the 30 year old 3.5 B&S mower it replaced. Not only was it weak, it has numerous problems. A blown head gasket was the final straw. I fixed it and sold it. I replaced it with a 5 hp Honda powered YardMan from Walmart that seems to have more power, is far smoother running, and much quieter........Maybe I will fill that card out now that I know what it is for.

The Lawyers make money. The Companies lose money. Those that get a few bucks (and those that don't), will pay later when they buy new equipment.

Is the world really a better place because of this lawsuit?

I got one also and was wondering whether or not to fill it out....if I do would I be in a 'lawsuit' where there is a possibility (even if very sligt) that I would be called to a court case? I was wondering becasue it says on the card that once you fill a claim out, if you dont withdraw your name from that claim by a certain date you are 'legally bound' and 'you may hire a lawyer at your own expense'.
All this law stuff confuses me....probably why im not a lawyer:rolleyes:

I got a card in the mail talking about it. I have also heard adds on TV or Radio about it.

I have purchased both a riding mower and a push mower in the time period they are discussing. I have also bought a weedeater, gasoline powered generator, and a pressure washer. So, I might have up to 5 things that the lawsuit would apply to.

But, I read the paperwork and saw that I could get "up to $35" if I bought a push mower and thought "who cares?!?!!?!".

I am sure a lot of people will get in on it, and a lot of individuals will get their $35. The industry will pay millions, the lawyers will get millions and I might get $35. I see it more of an issue with a bunch of lawyers USING people like me to get themselves a LOT of money, while screwing over B&S, Kohler, Craftsman etc...

Everyone knows the HP ratings on engines is not exact. Heck, when they started putting ethanol in our gas, the output power of our engines went down. If you live in Denver, it will make less power than if you are at sea level. The engine will make more power in the winter than it will in the summer.

I really hate the "Sue Everyone" mentality that we have now in this country. It only results in the consumer paying more for their products.

I was involved in one for Devilbliss. They said their portable compressors(in my case a craftsman) underperformed as far as CFM was concerned. I got 2 air hoses, a LVHP painting gun, and a 1/2" impact gun.

I was horrified when I found my 12HP only ran at 11.75HP. Then I got my $75 check and mounted nitrous to it. Now I get 90HP on straightaways and am suing for over-performance.

I bought a 20 hp craftsman rider last year. I have often wondered how is it that an old Garden tractor does just fine with a 14 hp motor but my Lawn tractor needs 20??

I doubt I will bother trying to get my $75 but I am curious what the actual HP really is.

Any chance your new 20hp has a hrdrostatic trans, where your old one has a gear trans? If so, there's the need for the additional power, right there.

I've often wondered the same....My family owns a lot of property, plus maintains a cemetary. Right now, we have 4 John Deere riding mowers. They are all "newer", as in less than 15 years old. They all have bigger rated engines than the 70's models they replaced, but don't seem to have as much power as the old ones did....We had a 1978 312, which was only rated at 12 hp, that we bought new and ran for nearly 20 years. It would run circles around the new, alledgedly more powerful mowers.

Possibly the key words here are" "Seem To".

I got a chance to drive the spittin' image of my teenage dream car, which I owned way back then-1970's. (1970 Buick Gran Sport-455-Stage 1) I was amazed at what a "sled" it was. A pig-in general-compared to todays offerings.:(
