My SIL is a security guard for a large factory. The security is contracted by the company. Now here is his problem (and ours as we are helping financialy). He never got his check from 4 weeks ago. They cancelled it and said they sent another which they haven't received either. Now he was supposed to get paid this last Friday with 2 checks in the mail Monday. None has been delivered. Their rent is due as well as their utilities. We helped with food and paying their electric. We have our own bills that we are obligated to pay as well. We just don't have enough to go around.

I just find it hard to believe that the security company would keep working these guards if they don't have the money to pay them. He told me that about 3 months ago, many payroll checks bounced. He called the labor relations board, but they said that there is nothing they can do about that. So does anyone know who he should contact? Its not right to provide a service and not receive pay. Is he an armed guard? Could get the guards together and go guard the bosses house.


Sorry, not much help.

That really bites.

Other than filing a smalls claims action, I don't think he can do much.

Is anyone getting their checks?

Time for the "blue flu" ?

Easy fix.

Department of Labor!

If they claim the checks are in the mail and they were not..... depending on the location of the main office...... if it is in State then it is the local authority to investigate...... if the business is out of State then it is Federal Mail fraud!

Why not have your SIL drive to receive a check in hand...if close enough.

Payment for wages earned is due immediately.....not net 10 or 15

You have some reference to any law or ordnance that requires this?

Every company of any size that I'm aware of (obviously mom & pop operations don't apply) requires at least a few days to process your time before it can be paid. What you'll typically see in a weekly paycheck is that you will be paid the following week for time that you work in the current week. If it's a bi-weekly cycle, you'll have to wait 2 weeks brefore you get paid for your current work.

Not much help with the OP's problem. Seems the place to start is the security companies payroll department. How long does it typically take to get a check once it's mailed? If it wasn't mailed till Monday, I'm not surprised that it wasn't there Tuesday (yesterday). One day is asking a lot from the post office, especially when you don't know how late in the day they got it!

This is why you should use direct deposit.

I am not a payroll genious, I do manage the time for 13 guys, but then it goes upstairs. I have 4 business days after the pay period ends to get it to them. They then, have 3 business days to turn it in to accounting. From there, it goes to the treasurer, who has 2 days to issue payment. Payment is in hand on the tenth business day with DD. Checks sometimes come a day later due to mail irregularities.

There are a lot of people involved in getting someone payed. Any mistake in any one department can mess up pay checks for a lot of people.

But I would think that per the OP's question. Or statement rather, the company is trying to figure out how to take from Peter to pay Paul and Mary is coming up short all around. It would appear that they are in trouble. I would be concerned about them possibly exploring bankrupcy protection and stalling on payroll until they are covered. Not saying that is what is going on, but it fits.

Just an opinion...

The security company is going belly up. Probably not paying a lot of other bills as well.

Sounds eerily similar to the situation at a Crowne Plaza hotel in Cedar Rapids IA about 2 years ago. Payroll checks were bouncing or being refused by local banks and ultimately stopped coming at all. Vendors were refusing to deliver unless they got cash on delivery so the resuarant shut down. Some employees quit, some were fired to cut costs, others hunkered down and kept working for no pay hoping the situation would improve. It didn't. One worker finally went to Iowa Workforce Development and got an investigation started. Among other things, they found that the management company had for several months collected health ins premiums from employees but didn't pay the ins company. Management called it a "payroll glitch". Lots of findings but no pay for the employees.

The hotel ultimately was foreclosed and was sold at sheriffs sale to the mortgage holder. The court appointed receiver improved conditions considerably and actually hired back some previous employees but this was about 4 months after the payroll problems started. Whether back pay was made up or not I don't know.

I hate to sound gloomy but it doesn't look good.

Most likely what otheres have said, the pay checks are the last thing they stop paying, if they can't cover payroll things are really wrong.

Regardless your stage should have a wage and hour department of some sort, he can file a complaint.

until then, no checkie, no workie as far as I'm concerned.

Thanks again guys. I had told him that it would be wise to find something else. However it is the typical problem of not enough employment in the area to supply jobs for the unemployed. When our GM stampling plant closed, so did all the other support shops.

The idea of the security company having money problems is what I suspected as well. Just hard to believe since they are a well known company that has many clients.

I'm hoping I can get him back into night maintenance at one of the McDonalds that I service. He quit on bad terms and he doesn't want to swallow his pride. I told him that he has to do what he has to do to feed and put a roof over their heads.

As for the Labor Department, they said they couldn't do anything about it. They only deal in harassement type situations and discrimination. They suggested small claims court. The maximum you can get from small claims won't cover what they owe him. Just a bummer all around......

At least my employer tells me when business is down and do what I need to do not to spend money.

Give them a call and you may be surprised what their involvement will achieve.

all the guards go to the factories, managers office. let them know they have not been paid. and they plan not to show up for work. leaving them without security.



that has gotten many paychecks in the past.

Son in Law got some good news today. He still hasn't got his checks, but his boss is going to Toledo tomorrow to pick them up personally :D Can't ask for any better boss than that..

That sounds almost as good as "the check's in the mail"....Let us know how it works out...My guess is there is no money and will be no good checks.
