It is very sad to see a child lose her life through neglegence. That being said & having a little girl about the same age, & having been there at that spot earlier that day, and many times before, I can tell you that the shadows around that bridge get tricky. I feel for the family as well as for the other boater as he will have to live with this. As for his 4 hour delayed test, That is for a blood test, but I sure he had to take a field sobriety (blow in the tube) on the spot, which he also passed. Sad but the news tells you what sells there show!! A lot of the underlieing cause will be Failing to have appropriate look out on both baots, & excessive speed for the conditions. As for stand-on, or give-way, the over riding rule is take any action to avoid collision

it appears she suffered serious head and neck injuries on inpact and died quickely<br /><br /><br />tommays

Years ago a friend died when he struck a huge<br /> lighted channel marker in a shipping channel he traveled many times.Dont know drunk or sober.<br /> A week or so ago a boater in approximately the same area struck a 25 foot lighted channel marker.Both these folks were probably moving too fast and not paying attention.When I travel at night I try to imagine Im invisable and it is up to me to be sure nobody runs into me or me into them.

It may not always be advisable to take "any" action to avoid a collision. For example when a power driven vessel is a stand-on vessel and ends up having to take action to avoid a collision with another power driven vessel "shall, if the circumstances of the case admit, not alter course to port for a vessel on her own port side" (Rule 17 c)

I believe that when a situation of converging boats occurrs, try to miss the other boat. Chapmans be danged, screw the rules whe your neck is at stake.

you posted this on monday meaning it most likely happed sunday night ??<br /><br />I was on the water sunday night .. there was a bright full moon out .. unless it was cloudy there how could they not see or even hear the other boat :confused: <br /><br />sad the girl lost her life :(

confused is probably right, 4.3sunbird. The first post was on August 19th, a Friday.

There should be a law that you are not allowed to go fast at night, i go out at night and very slow too scary at night, but people still fly at night all it takes is one boat w/o lights on and then it is all over!

Just for the record. The drunk operation charge has been dropped. There was no evidence since his tests came back zero.<br /><br />To me it does appear boat two would have the right of way. That area is large and it's deep. The biggest contributor to me is that you can easily lose a boats lights in the shore lights on the south shore of Long Island and especially that area which is what probably happened to vessel one...he didn't see vessel two and failed to give way. The same could probably be said for vessel two...he lost sight of vessel one in the background lights of Fire Island. That combination plus speed is a recipe for danger. <br /><br />I am a proponent of no wake speed at night when inside the inlets here regardless if you have radar or not. It's just too crowded out there and easy to lose a vessels lights in the shore lights. But that is just me.

The fastest I will ever travel at night it 25 MPH. I also give tons of room to another boat, cause you never know what they will do. You might be running parallel coarses close together and then the other guy take a 90 degree turn right into your path.<br /><br />You also have to remember not everyone has 20/20 vision. There are many people that dont wear glasses when they should. And also some people have night blindness. Perhaps that played into the collision.<br /><br />I would have to say that neither captain was paying very good attention. Had one of them been watching, the collision would have been avoided.<br /><br /><br />Ken
