1988 Yamaha 40hp oil leaking from water intake?

Hey Guys:

My son just bought a 1988 40 HP Oil injected Yamaha outboard. We noticed what appears to be oil leaking out from the water intakes. I do not think it is lower unit fluid. There is some oil around the bottom of the engine compartment as well...I was thinking this may be due to the seller filling the oil resevoir to the top and maybe leaking out when the motor is tilted all the way up for trailering. Is there any way this could be traveling down inside the lower unit housing and escaping from these intakes??? Or am I just dreaming and we have a much more serious problem?

It 'appears' to be oil? What does that mean? Is it oil or not? Can't you tell if it's oil?

Thank you for taking a look at my thread. What I meant was that between lower unit fluid and oil, I think it looks and smells more like the oil. Thanks again...
