89 Evinrude/Tracker comes up in Reverse?

I just bought a 1989 tracker Pro-v 16 with a 89 evinrude/tracker 40HP the manual tilt assist has already failed and the previous owner installed a power tilt/trim but i don't think that is what is causing the issue.

Anyone know what is causing it to not stay down in reverse? i have looked all over the motor and cannot find a way to lock it down in place. from the searching that i have done online i find where a mercury engine has a cam that causes it to lock in the down position when it is in reverse does an evinrude have this too??? How can i check it out?

If it's got power t/t, is your manual release valve tight??

That is actually a good thing because if you hit anything in the water it allows the engine to move and causes alot less damage, I never lock mine.

I have an older 50 and there si a small lever on the port side of the engine mount that cna be flipped to lock the engine

The one lever on the side goes through the mount to the other side I can tilt it forward and back but It doesn't do anything and I can't see what it should be activating. There is a cable that goes to the old manual tilt assist cylinder that isn't hooked up to anything one the top end. Will take some pictures and laity them later

another linkage that is connected to the gear box linkage (don't know what this does) its the sliver thing with a ball towards the right of the picture.
