Boat yard blues

I have a question about responsibility, basically who?s responsible. I have a 23 foot bow rider that I keep in the Barnegat Bay area of New Jersey. I mention this so you know the boat spends 6 to 7 months a year in salt water. The boat has a Volvo Penta 5.0 I/O I have my boat winterized by a boat yard every year and pulled from the water to be rested on blocks in my yard. When the boat yard winterizes my boat part of the process is to remove the drive, inspect the universal bearing, joints, bellows, shift shaft etc. Drain the gear lube and refill, reinstall drain screws and replace gaskets. Grease shaft and all zerk fittings and finally reinstall unit. This year when I went to pickup my boat they told me I seem to be having problems with my drive. I spoke to the mechanic who put the boat in the water and he said I have no reveres only forward. He also told me they would have to pull the boat out of the water and remove the drive to see what the problem is. When I asked if this should have been noticed last year when the boat was winterized or this year before they put it back into the water his reply was don?t worry we will try to keep the cost of repair down. So after all that history my question is... am I responsible for the repair or should the boat yard make good on this?

Unless they caused the problem you are responsible for the repair.

it could very possible be a shift cable miss being connected.
