Cracked Block- Mechanic Won't Fess Up

Alright, I had posted a couple of weeks ago about a bad experience I had with a local mechanic that had done numerous work all last summer on my 5.7L Mercruiser w/Bravo III and how my issues never went away. The full story:

To summarize, I was having RPM issues early last summer. Took it to a mechanic, they said blown head gasket and replace it. Then I start getting water in my oil, they then claim that the block was cracked and they missed it. They agree to install rebuilt engine from Rapido Machine and only charge me the $1650 for the engine since they missed the cracked block. After the install I noticed many issues, bilge pumps didn't work, blowers didn't work, ground wires not hooked up, hoses not routed correctly and worst of all, I was getting water in the oil. They would change the oil, give it back and we would go through the same story. After a couple of weeks it was the end of the season so they winterized it (but kept the milky oil in it) and
​​​​told me to come back in the spring and they would go through it all. I lost all confidence in them and felt they were just putting Band-Aids on it until the warranty ran out.

I took the boat to a new mechanic who informed me there are 2 cracks on the block that appear to be freeze damage. So now I'm onto my 2nd rebuilt engine in 2 summers. The original mechanic refuses to cover any of it because I took it elsewhere and because they appear to be freeze cracks Rapido won't cover the warranty. I already have another rebuilt engine being installed by the new mechanic (with a 3 season warranty) but I want to take this back on the original mechanic even if it's just for the $1650 I paid them last year for the Rapido rebuilt engine. I figured approaching them and giving them the ultimatum to either give me the $1650 back or I would go over them for the full $3900 that I will have for the new rebuilt engine and install.

Does anyone have any experience in something like this? Would it hold up decent for me in small claims court?

Don't have any experience, but I'm sure small claims court is flooded with these sorts of things . . . probably mostly automotive claims vs. boats.

IF you've got documentation of them winterizing the engine and now it has a cracked block, then you probably have a good case for improper winterization. The process of taking it to another mechanic can be considered a 'second opinion' since the initial mechanic was showing signs of non-performance.

This sounds like a classic botched engine job. You will need documentation to back up every step and turn in your story. Be ready for counter claims from the mechanic.
