Call the Harbor Masters office. They can tell you what is allowed. There may be specific areas for overnighting.

Be ready to purchase a DE non resident fishing license, they are requiring all that fish the bay to either license the entire boat or each person fishing.
Do a Google search for State of DE fishing license rules. They've been ticketing boats in the lower DE river and since NJ does not have a saltwater license, there is to reciprocal agreement between NJ and DE.

I think it's like $40 per person, I fish the bay all the time, but refuse to pay DE to fish off a NJ registered boat in NJ waters. DE has claimed the upper bay, and all waters on their side of the shipping lanes leading to the Delaware River. They claim rights up to the NJ shorelines in the river and upper bay and have been fining NJ fishermen in those waters.
