HUGE deal!!!

ok so heres the scoop... i bought a 1977 glastron ssv boat this summer from a friend with a 115 hp merc on it... the original engine I assume this motor locked up and i took it to a local marina to have it fixed... however was informed that it would cost more to fix that motor than to just buy a new one so i asked do u have anything comparable and he informed me he had a 115 hp evinrude so I agreed and we settled on 1100 dollars to transfer the motor over to my boat and Id just dispose of the original one at my leisure....

Heres the problem.. after being on the lake for the first time i noticed I wasnt getting more than 35 mph out of the new motor which i thought was quite strange since the gentleman had informed me the new motor should have more push than the older one and should be about the same speed. Upon pulling out of the water and further investigation I noticed the serial number says the motor is a 85 hp!!!! however the cowling says 115.. i went back to the deal and asked him and he acted like there was nothing he could do...

So now Im stuck with a way smaller motor than i bargained for.. What i would like to know is how much of an issue am i dealing with here is it worth getting a lawyer over... I feel like I really got screwed over here....

HELP please!!

try what ever you can before the lawyer.....does the bill of sale say a 115 hp?.......

thats a really bad trick......i hope the dealer truly didnt know about the wrong coweling.......

but he is on the hook for it.....there are several laws about it....the least of wich is called misrepresentation

if the receipt says 115, but the motor is an 85 then the dealer is on the hook. They are supposed to know what they are selling and be the experts.

agree, i had this happen when i bought a boat years ago, represent and an 80 merc, had a problem sent it to the shop, found it was an 80 with a 50 powerhead on it. i could not do anything with the individual.

If the receipt indicated 115HP, you've got a solid case and if the dealer won't anti up, even the threat of legal action may sway him to correct the problem.

You don't need an attorney, small claims is what this level of dispute is for. Regardless of what the receipt says, I'd say the dealer is on the hook. The cowling and serial number discrepancy seem like enough to me.
