hull dammage disclosure

Does anyone know if a seller is required to disclose if there was any major hull dammage to a boat prior to the sale?

BigDog49,<br />Boat sales are not regulated like automobiles so the seller is not required to make the disclosure. This is why we have marine surveyors. <br />The only exception is a new boat. It cannot be sold as new unless the dealer discloses the damage. On the used market, its buyer beware.<br /><br />Nav :cool:

Welcome to the board Bigdog!!! :) <br /><br />I image what you are asking will vary from state to state. Regardless of whether or not the seller is ‘required’ to disclose any hull damage, there is always the possibility of civil litigation if he/she knows of damage and does not disclose it.<br /><br />If you are selling a boat, disclose any damage. If you are buying one, ask for a written statement that there is no damage or better yet have the vessel surveyed. If you have one and discovered the damage and it effects the performance of the boat, talk to the seller about getting it fixed…if that goes nowhere consider legal action for civil fraud.

Small Claims Court is the place to resolve this type of problem.
