Hey all was crusing along and noticed odd bubbles ahead of me slowed down quick to discover divers !! (NO DIVE FLAG) turned quick and got more concearned about hitting the diver rather than the rocks that I have known about my whole life !!!
Any way took out the prop and the skag there is know a open hole that oil is dripping out of. The gears do not seem to be damaged any one have any ideas what a new case is worth ? or Am I better with a whole new unit? It is a 2000 4.6 sx volvo penta out drive

Oh man. I am sorry to hear about that man. Send a bill to the divers.

Hmm... check the local laws... usually divers are required to have a flag either with them or on a nearby boat... some don't do this, especially if the law doesn't actively require it on that body of water.

It's stupid on their part, since without a flag there's no real way to know divers are there and they may get hit by a boat. But that doesn't make the boat captain feel better.

Definitely do send the divers a bill if you know who they are... decent chance a small claims court will award you damages.

Or if you're insured, tell the insurance company and they may go after the divers.

I'm a diver myself, by the way... it's their choice not to use a flag, and it's their fault if someone damages something or gets hurt trying to avoid them.

i agree, i would contact my insurance company, have a mechanic go over the drive carefully, and send the bill(s) to the divers.

Believe me I am pissed and will deal with the divers as I am also a diver myself and have already called the local police for some charges. But I also would like to get some boating in this year and need to the unit fixed as quickly as possible before the breath of old man winter starts to blow. Any ideas would be a great help

You didn't say where you were. Being in the Midwest, I appreciate what you're saying about getting some boating in before it gets cold (like next week, probably). I know this is heresy on here, but I would consider dabbing some jb weld on the hole, building up a little more on the outside, and go boating. Just don't push any inside. Then in the fall have the mechanic go over it carefully and proceed with the legal beagles. You may want to ask them now if this course of action will hurt your legal case, though.
