The law is fine...the judge needs to interpret the law correctly. In this case identity theft was not the motivation, protecting his child was...so this should get thrown out very quickly IMHO.

We'll see how this one pans out.

I can see the "right to privacy" i.e. email and internet being written into future pre-nuptial aggreements. Once again, the lawyer's are the clear winner's whenever these events happen.

The interpretative opinion of the judge is fair. Take the names out of the equation, remove the gender and then make a decision. The judge can not take into account mitigating circumstances, only IF the law was violated. I realize it is a difficult way to look at things but it reduces laws down to the lowest common form.

Person "A" looked at the personal mail of person "B" without person "B" giving permission. There is no room in a law to ask the "why it happened" or "how it happened"......... bottom line it happened. The Court room is the arena for the why's and the how.

Has email been ruled as personal just like snail mail? If so, this might be a prosecutable crime. If not, it's not.

If he was worried about his kids he should have taken it up with the authorities. He took the law into his own hands. Can't do that. If she has a right to privacy, that right is only placed aside by a court of law, not some dude on the street.

Wife and I share the puter, there isn't anything in it that is private, let alone incriminating :D

Unfortunately, adultery isn't a crime. And why is that?!? It's only morally and ethically wrong..

I always say that if your mistress is going to call your cell, store her name under "UNKNOWN PHONE NUMBER". :D

Oh, but it is and it is a Felony in Michigan!!! :eek: ......... the evidence "obtained" was acquired through illegal means so....... it is not admissible.

I hope he gets off, either way hes going to need a lawyer either a criminal defense attorney or a divorce attorney, maybe both!!

This piqued my curosity (not that I would ever do it) so I started reading. Apparently there isn't one piece of information available on the web that you can hold as truth. I read a couple of states action(s) on divorce and for each one that listed it's states laws on this, there was another to counter the law. Each state has various laws on the books and label them from "adulterous affections" to "lewd & lacivious behavior".

Some call them civil laws only, whereas other sites list them only as an affront to moral turpitude. I read portions that said every states has laws against adultery to sites that say no states have laws concerning it (as far a prosecution).

I guess the only way to know would be to consult an attorney...

Remember when you could get factual information from the web? I have now given up hope...:(

This is such a load of crap. The house is both theirs the and all their assets are equally divisible, including the computer, so any information on the computer are, I.E. e-mails, which if he is paying for the internet should be accessible to him no matter who it was sent to. e-mail is not like regular mail(federally regulated) in which it is a federal offense to open if not addressed to you.

This is a precedence setting case which someone could make a big name for themselves if won, but could and would be a big problem for society if her attorney wins.

Just think of all the companies out there who watch their employees e-mails and what repercussions this could create in the business world.

Currently, companies DO read and track any e-mails on company property siting that it is company owned. There have been many cases of companies reacting to an employee's personal e-mail on a company computer. This though, I believe is different siting communal property rights.

Don't blame the web. There is so much "law" on the books that to find it conflicting with itself would be the norm.

If thats the case. When you own stock in the company you work for then they have no right to review your e-mail, as a co-owner of the property
