Selling My Boat, Have a ?

I am selling my boat hopefully tommorrow. I <br />do still owe money on the boat. My question is <br />can I just sale the boat with a Bill of Sale and<br />pay the bank on Monday? Also what all should be<br />included on the Bill of Sale?<br /><br />Thanks

You will not be able to hand the buyer a clean title if the bank still has a lein on it. So the buyer may be reluctant to give you all the money if he can not get a clear title.<br /><br />Perhaps you will have to meet him at the bank to complete the transaction on Monday.<br /><br />Receipt should include the time and date, "as is-where is" or "no warranty" condition disclaimer, hull id number, motor serial number, trailer serial number, as well as a description of all three. Also the selling price, the amount of the deposit, the balance due, and a date by which the sale must be completed by or it will be cancelled ( deposit forfeited).<br /><br />Have it all written up ahead of time and fill in the blanks with the appropriate numbers. It can all be done in 3-4 simple sentences.<br />Make two copies, you and the seller sign both of them, you each get one copy. This receipt will serve to protect both of you in case something goes wrong.<br /><br />I also make a note about anyone that buys from me or sells to me. Such as address where I picked the item up, phone number, license plate number of their vehicle(s), names of friends that are with them. This makes it easier to track them down if the need should arise.

When I've sold things that had a lein I explained it to the buyer and had them accompany me to the bank. They would pay off the title and I would sign it over to them right there. Did it a couple times and never had a problem. <br /><br />Good luck.

In writing give them a form, signed by you, stating you sold whatever it is with whatever sierial number on whatever date. Then pay it off and transfer ownership at your cost and time. It's a pain, however you won't get burned down the road as I have.(parking tickets years later) ((By a police officer none the less.))
