I know that Don was forced to remove his service manual links recently; but I also know that prior to that, the service manuals were available for download as a pdf document. Unfortunately, I did not download Service Manual #8, although I did open it and look as some of it.

I still don't know if it could actually be "downloaded" (saved as a pdf file to your hard drive).

But if it could, and anybody here did that and thus has it, could you please PM me. It obviously was available for download at one time; so if you did it then, it's yours now and there's no problem with sharing it with others if you choose to. You didn't steal it; you obtained it legally and you can do whatever you want with it since it's your property.

Wow, that's about the most outrageous internet lawyer claim I've seen in the last couple of years!

Not quite true... The real truth is that even if you paid for a copy (hard of pdf) you DO NOT own the copyright. You can not legally make a copy and give it to someone....

Merc have every right to shut down the manuals. Doesn't mean we like it, but they own the copyright and can (and appear to be) enforcing that.

Even if you pass them by email, technically you are infringing their copyright and they can come after you with the full weight of the law behind them.

Microsoft did it a few years ago. They nailed a few people in Australia for illegal software (books and manuals are no different), and the cost was no small sum!!!

That doesn't mean we have to like Merc for doing it, and I would recommend that if you don't like it, take your business to the other manufacturer, who is allowing their manuals to be shared. When my engine's due for an update, I'll be giving Volvo a very serious look.

Doesn't matter how many times or in how many places a copyrighted item is posted. It's still illegal unless the poster has the owner's permission. Only reason the manuals were available for so long is because Mercruiser didn't choose to exercise their rights until now.

If you're smart, you'll download a copy of the Volvo manuals while they're still available ....... :eek:

Exactly. They shut them down. Meaning they stopped making them freely available.

Which they previously had done. So you REALLY think they'd go after someone who had previously downloaded a free copy that Merc had previously made available for free?

Maybe they do that in Australia, but I'm from New Jersey and they ain't doin' that here.

I never said you owned the copyright if you made a copy. Of course you don't. Duh!!!!

But if you think Merc is going to prosecute someone for passing on a copy he got for free -- from Merc when Merc was making them available for free -- you cannot actually be serious.

Microsoft is an entirely different situation and has no comparison to this one.

45Auto - You are also misinformed. It's called estoppel and there's no way passing on a copy of the service manual is going to result in prosecution.

Merc never made them available free... The link they had on their website (over 2 years ago) was password protected and for dealers only.... The password got out and they lost control of the access, so they shut it down. Someone who had already downloaded some or all of the manuals then uploaded them to a file server and offered them up again. That site has now been told by Merc to delete them from the server.

Do I really thing Merc (or anyone else trying to protect copyright) would go after someone with illegal copies of their work? Damn right I do! They only have to nail one person to scare the others, and the cost of the penalty, in Australia, $20,000 for an individual and $100,000 for a business.

That's what's great about a free society. Anybody has the right to think whatever he wants.

P.S.: If Merc didn't make them available for free, then I don't think they're too interested in prosecuting a few folks passing on the odd copy. They'd likely be looking to spend their money finding and prosecuting the folks who gave or got the password which allowed all of us to get a free copy. Apparently, they're not even interested in prosecuting those folks since they merely told them to just stop making the free copies available.

Yea, I know that not all of them are still available. If you look at his post you'll see that he updated it to that effect.

I only put the info up because it appears to be a comprehensive list of what each of the manuals pertains to. So the one for my engine is Service Manual #8. For my sterndrive it's Service Manual #6 (which IS still available).

If I had a 1983-1993 GM V6, I'd want Service Manual #7.

And so on.
