Hey Guys:

Yep I finally did it, I sold the boat. NOW I am writing out a bill of sale. What are some important things to include in it, and what is the best way to word it so that if anything happens they cant come back at me? Thanks for the help.

You want to make sure you have the HIN, the serial number of the motor, the year and serial number of the trailer, and as Gary said, AS IS.

Re: Sold the boat! Bill of sale Questions

I've recently asked the same question on here and I got a lot of good advice. I have two different versions that I'm considering and maybe you may want to take bits and pieces of it:

The boat is sold AS IS WHERE IS. THERE IS NO WARRANTY AT ALL. I am not responsible for anything that happens to you or the boat. The buyer is relying solely on his/her own inspection, and not on any written or verbal representations made by myself or anyone else as to the condition of the boat. Buyer is responsible for pick up or shipping.

The item is being transferred on an "as is where is basis" with no warranties expressed or implied as to the condition of the item. Furthermore, the "buyer" agrees to hold the "seller" and his heirs free from liability if any damage occurs from the use or transportation of the item sold.

Good luck! :)

A description of the property, price and sold "AS IS, WHERE IS". Anything else is nothing but fluff that a slick lawyer will twist around to use against you. The more you put on the bill of sale the more chance it can be argued about in court. If you're that worried about legal recourse get a lawyer to draft your bill of sale.
