stalling engine on my 40hp 1993 yamaha

I have a 1993 40hp yamah made by mariner, the engine starts well and when it is out of the water it goes into gear without any problems. Once the boat is in the water as soon as I push the throttle forward it stalls every time unless the warm up lever is raised a little. Once the boat is moving I can push the warm up lever down and the engine runs fine, untill I put it into nuetral and into gear again, then it will stall again. The engine does not have a choke. I have recently had the enging fully serviced. Is this a major problem, and can it be fixed easily. Thanks guys.

The engine does have a choke but it doesnt seem to be attached to anything inside the engine.
