Tilt up bracket on 9.8 msfa3 - spring loaded?

Hi all does anyone know if the tilt bracket on the 9.8 mfsa3 should be spring loaded? Its the mechanism with the side handle to latch the motor right out of the water.

It automatically locks into shallow water mode (i can see the spring on the bracket) but the full up position isn't locking into the groves.

Mine doesn't seem to be; but I checked the mechanism and the spring and two bushings are in there correctly. Had a 6hp before and it was spring loaded so not sure if this one is or if something finicky is going on.

What could be the problem then? Where it bolts in at the top looks good, and the bracket, 2 bushings and spring behind it look in good shape as well.

Is there something missing? Don't see anything on the parts diagrams.

Here's some pics. The shallow mode works you can see the spring there, but it seems nothing is spring loading the tilt lever in the picture even though there is a spring behind that bushing in the 2nd picture.

From the snippet in the 3rd photo parts 35,36,37 and 38 look to be intact and are the only ones that look to have an impact on that tilt lever.

There is pressure from the spring against the lever when i bolt it back on.

Looking at the 2009 parts catalog, there appears to be a spring part# 369-62434-0. Did the earlier mfs98a3's not have this spring then? See 34-2 below

I'm thinking that the earlier models didn't have this feature but can order part #34 above and it will fit - part numbers seem to match up around it.

Almost, but not quite. There is a tech bulletin for the revised spring mechanism. Yes, the new part will fit.

A spring has been added the tilt stopper action. Due to this addition, the part number is superseded, and the old style round
stopper spring is not needed. Spring (369-66112-1) is deleted.

You would replace the old Tilt Stopper 3V1-62431-0 with the revised part 3V1-62431-1
