Official Recall Notification for all Nissan, and Tohatsu 70hp and 90hp series TLDI models.

This notification was issued in June this year because of the extreme risk of fire from the failure of a high pressure fuel component due to abrasion against other parts. This particular recal has number, 08-003 but I don't know how to use the document that I received to track the history or effect of the problem, and although it applies to a problem that has been well known for a long time, there is no way to find out how Nissan/Tohatsu decided to distribute this notification. I would like to know why they decided to put out this bulletin now, as opposed to three years ago or next year.

My question, which I think applies to the entire forum is: Is this type of notification, common, given the heading "U.S. Federal Boat Safety Act" and is it just the equivalent to a service bulletin, where it is up to the customer to decide whether the cost and time are worth the trouble of doing the repair. Or, on the other hand, does the corporation have a legal responsabilty to see that the repairs are made by compensating the customer for time and transportation costs to take a motor to a dealer?

Thanks.

Re: U.S. Federal Boat Safety Act.

There is a pretty steady stream of recalls on boat fuel systems from things as simple as bad heat treating on a Fuel injector clip

As well as many other items when they are found to out of complaince, which is over 1500 hulls right NOW;)

Re: U.S. Federal Boat Safety Act.

Thanks for the replies

I don't know whether the number of recall notices is reassuring or not, sounds like mostly bureaucratic problems for there to be that manyrecalls.

No, they will not pay the cost of taking it to a dealer, and for me this is substantial. I have dealt with the problem from a safety perspective. I was looking for a preceedent. because the recall notice worries me more than the problem, and after thinking about how you viewed the question I think I could have worded it better in general terms such as:

Who is liable for damage caused by failure of a part after notification/recall of the faulty part? Once the recall is official, do I now become the person legally liable for harm caused by part failure, so that I am now under a lot more pressure to take the motors to a dealer and have them certified as fixed? And you are right, us peons can't figure this stuff out, but maybe someone already knows the answer.

Thanks
