Has anyone noticed, that when you buy a new car, Papers completed, funds signed over, that your Salesperson or Finance officers watches and waves to you as you leave the lot? I think it's understood that you assume ownership when and after you take said vehicle off of the lot. (Sure, they are nice people and all but they are making sure you leave) If the boat was new and the dealer was completing the outfitting, I think the buyer could expect the boat that he purchased. Now if the boat was on the lot due to maintenence or installation of some kind...well that may be an insurance call.
I don't know, I maybe wrong.

I'm just relating my personal experience working in the automobile business. Once insurance companies get involved, common sense goes out the window.

Just imagine, the boat dealer submits a claim to their insurance company. Said company sees the boat is in fact owned by the customer, not the dealership. What do you think their response will be? ;)

Had not taken delivery.

So he didn't sign the paperwork and pay for it? If he did then he did in fact take delivery. You don't have to physically take it to take delivery ;)

Example, someone buys a car, then wants it customized at the dealership, with graphics, add ons, whatever. The customer owns it and has taken delivery, even if he never took it home yet.
If the car where to get stolen, it's the customers insurance that pays, seen similar scenarios over the years.

Customer OWNS it but its in the posession of the dealership, under their stewardship.

Try it like this.
Take your car for service, they drop it off the lift.
They tell you to just call your ins agent.
Where do you tell them to go?

Either way, in this instance the guy who stole it will be paying...and paying.
He's literally dying of self will.

Totally wrong analogy.

Try this, take your car in for service, and it get's plowed into by someone driving by, or stolen, while sitting outside the service department.
The customer's insurance pays, not the dealerships.

Of course if they drop it off the lift, or an employee runs into it, the dealership's insurance pays.

ok guys im sure every state and dealership is different........ or maybe its the diff in insurance policies.

when i worked at our local ford dealer we had some theft take place.

i had just bought a brand new truck so my old truck was in its parking spot in the back where employees and finished cars from the shop park..... one tire had gone flat the same day i bought my new truck so it sat there for a few days before i made time for it... i just bought a brand new truck you think im gonna jump out there and change a flat the same day?... lol

someone stole my 3 month old edlebrock carb, an old crappy van we were working on had the radio stolen (cheap pioneer), and a few other various things from other customers cars... too petty to remember.

2 days later an insurance man shows up and the owner called me to his office. he and the insurance man asked me what kind of carb i had, how old it was, and if i had any proof of purchases. luckily i had bought the carb through our dealership from a local parts store and charged it to my account. after producing said info the insurance man wrote me a check for $532.59.. the price of my carb.......... and the next day i was sent to best buy to get the crappy old van a new radio...... i guessed that since i was the only mech who rattled the building with my radio they picked me to get him a good replacement...... just in case you where wondering hank jr has some pretty good bass ;).

i will say though that we werent allowed to leave our cars there for any long length of time after that incident.... nor were customers:eek:.

Very interesting prospectives- I need time to digest all of this info. I will be throwing back a Corona tonight for each of one of your posts while I contemplate.

the boat would probably still be in one peace if the boat had been properly strapped down

I ?took delivery? and signed the papers after we had taken the boat out for a day on the lake. It was a simple matter telling the dealer that I would not be writing a check until I was sure that everything operated as advertised and to my satisfaction. They marked it up as a ?test drive?.

The boat actually didn?t become mine (or my responsibility) until after we got back to the dealer.

Apples to oranges, how do you know this guy didn't pay for the boat?

What's the big deal? That's normal driving here in Connecticut. The local stations here went nuts with that story I got sick of hearing about it.

that is why lawyers and insurance adjusters make terrible shark bait, sharks won't bite. It is a proffesional courtesy thing:eek:
