Generally, you would start the engine with the outdrive an a lowered position. Not sure about the water, but see how things look with the outdrive in a lowered position.

Boatus.org has some guidance on the posted capacities. According to BoatUS it is not a federal offense to exceed these ratings. It may be a violation of your local regulations to exceed the posted capacities of a boat. So, check with your local (state) regulations on boat capacities...
It may be hard to pinpoint the exact location of the leak beyond what can be seen in the video. A borescope can help, but you may have to start taking things apart. Pulling the outdrive would be a whole lot easier than pulling the engine. So, start there.

Odds are that there is a leak at the transom seal. These are often caused by the transom rotting.
Not sure about 4Winns being wood-free, but maybe. Often the stringers are synthetic, but the transom is wood core. Boat companies usually do not...
