With that being said, here's the way it goes. When you sue, sue everybody in sight. The judge will sort it out as to culpability.
Years ago, my father bought a new Pontiac. Soon it's differential destroyed itself. Local dealer fixed it, but wouldn't honor the warranty. Dad got a lawyer and sued. At the advice of the lawyer, suit was filed against the dealer that sold him the car, the dealer (not the same) that repaired the car, General Motors, Inc., and Pontiac Division of General Motors. No one expected all parties to become participants, but no one was left out. Sure enough, the judge sorted it out and dismissed the case against all but Pontiac Division. That's just how the game is played in law. If you sue one interest, and the judge decides that interest isn't culpable and dismisses the case, you have to start all over.
In this case, the lawyer did just what he was supposed to. Seems to me he just didn't have a case to begin with, but if you're determined to sue, sue everybody in sight.
