Advice needed....a part vanished from a box while in shipping...

My dad ordered a few parts for his new-to-him backhoe. Well, we got the box in, sealed up in a rough manner but not unheard of for that company, and it was empty. Just packing material. This was darn near 100 dollars worth of parts.

Well my father calls the company and they say the only way they will send a new part is to charge his card again, and then if UPS settles with them and reimburses them, they will then charge back my dads card.

I told my dad that's bull****. That item was either never packaged (they say the box weighed 7lbs leaving their facility) or it was stolen or something along the way, but either way, it's not your responsibility to pay for 2 parts and hope you get reimbursed back. He's such a pushover, he actually said, "I don't want to **** them off, I need them for future parts." Oh screw that, they're a name brand, they won't stop selling parts to you if you refuse to pay for parts you never got.

He paid with a card, and I told him that if they don't send him another part, to call the CC company and say you never received the item, to charge back the amount. Then it's on the company to prove he got it, and the UPS man handed the box directly to my mom when I was standing 5 feet away, and she handed it to me. It definitely never contained the part, and I will testify to that in court.

What should be done? Right now dad has a call in to the manager and he said he would "see what he could do, but that it's normal procedure for them to charge a customer a second time in order to send a second part." Well, that's bull****. We can't be responsible if UPS loses something. At least my mom has guts, she is feisty and will stand up to them and not let them push over my dad whos a big softy.

Dad says, "They're real nice people to deal with." I responded, "Nice people wouldn't charge you for a part you didn't receive."

Was the box repaired @ UPS? I used to do that when I was in college. Boxes do break when they get caught in the conveyors. Most of the time parts fall out. I would not have been allowed to forward an empty box. The paperwork would have come back to me with a "Wassup?"

Also, companies have been known to ship badly packaged stuff that was short of the customers order, then blame UPS for "losing" it. The driver is supposed to refuse such packages when they see them.

I would call the credit card company, cancel that charge, and order the part again. Let the card, the company, and UPS fight it out.

If UPS took it as stated at 7lb then delivering 7lb less to the destination would make them liable.

I had many dealings with shipping and problems. Sadly...... :( it is up to the shipper to place the claim and UPS is not the fastest.

UPS just followed their protocol when your Dad needed a replacement ASAP. It is the way the merchants do business with UPS.

I guess I can only say "ride out the system" and it should all work out.

I would start with the credit card company. They will most likely just do a charge back to your dads account.

I do a lot of part shipping where I work, we try to UPS proof the package but sometimes they still get torn open, I always insure, it does take a while to get UPS to pay up. The one case I had they actually returned the torn box to me and I started a claim from there.

I had ordered a part one time, personal order to home, came in damaged, I picked up the box, looked at it and from my work experience got my camera and started taking pictures, then opened the box, found a damaged part in the box, more pictures, loaded pics in computer, emailed to the company I ordered from the next AM, within about 2 hours they replied with, another part is on its way and for me to hold the damaged one, UPS did come pick it up a few days later. The company took care of me the customer and with my photos went to work on UPS.

To anyone ordering things to be shipped to you, first thing you do is look at the package, if damaged get your camera and take pictures of the damage, after you take the pictures then open the box and inspect the contents for damage, if damaged or missing take more pictures and contact the company with the evidence to back up your claim. This tells them you received a damaged package and that nothing was in it or the contents had damage also. Many companies will just send you another order or part a few may not want to do that but if you send them evidence it could help.

Once I received a n industrial sewing machine (heavy) shipped via UPS.
Box was all intact, but when I opened it all plastic parts including cabinet were in pieces. UPS and seller took care of everything, I was refunded in full by both.

I would contact the credit card company and tell them that you received the box with nothing in it. Say nothing about the condition of the box and don't speculate as to whether the parts were never put in the box, or if they were lost in transit. From your end, you really don't know and it isn't your problem.

Ask that the payment to the supplier be "reversed" and once that has been done, order the new parts again. From that point, let UPS and the supplier fight it out.

read the agreement on the back of every CC bill,
you have to folow up the call in writing.

Wow, joined the forum just to ask that? Welcome to Iboats, and no, it was the Allmand dealer. The main one, not a local one.
