IMO a boat listing could not be labeled (yet?) under contract and the boat could still be off the market.

Sorry, but I agree w the broker.

Unless you know he showed it to other buyers....

I bet you could find at least 1 boat thats been sold and removed from the consignors lot, not just under contract, on most boat listings sites.

Besides, has nobody ever agreed to buy a boat, sent a deposit and still walked away?


He told me that he has 5 other people waiting to buy the boat.

Only if you dont complete the contract. Not to sell it out from under you. Correct?

I would drive 2 hours, take one last look at the boat to make sure it is in the same shape as when sea trialed.

Finish the transaction and go to lunch or dinner to celebrate.

The question you ask shows you are worried or stressed about it. Do it the way you are comfortable doing it and be happy.

Personally I like to hand over money and get property in my possession with paperwork. No doubts or stress involved.

You can have an accepted offer, and there can be additional secondary offers as well.
But until the transaction is finalized, the property is still for sale.
The signage is still in place, and likely still on the website.
The broker has a fiduciary obligation to the seller to do so.
He works for the seller. .


Now, if he really ticked you off, then walk away from the deal.
Then he can sell it to the next buyer in line, which is his job.

You can do a Google search for all kinds of legal wisdom on the subject, but each party (you and broker/seller) would have an original signature on a copy of the document.

As far as the question about listing the boat, you had an accepted offer with contingencies (sea trial and survey), so it was/is not 'under contract' until those contingencies are lifted and you enter into the actual purchase and sale agreement, which I assume is what they want you to sign.

If scanning the documents are really a concern for you, make the 2 hour trip. FWIW - with the boats that I have purchased, I asked to have a copy or see the title to the boat/trailer before making the payment of final money.

I've decided to just print the contract , sign it at home and bring the contract and money on saturday when i go to work on the boat, that way ill get tittle the same day.
