To me, it all boils down to whether or not the seller knew that the transom was shot and whether or not he attempted to cover that situation up. If both are true and the OP presents that to a reasonable degree, he might have a chance at getting all or some of his money back.

Remember that we are not talking about a criminal court, where rules about evidence and proving your case are more strict. All the OP has to do is convince the judge that the seller knowingly sold him a boat with serious problems.

And without any contract/bill of sale etc.

The seller say of course I told him, one look at the transom with all that "goop" on it, there is no way I could have hidden it......

All the seller has to prove is that he thought he fixed the problem to the best of his abilities, and that the impact brought out problems that weren't apparent at the time of repair. So at the time of sale, you would need to prove that the seller KNEW that there was a problem...also if the bill of sale (if there was one, and you signed it) says as is where is (which all my private sale receipts say) and the buyer signed it...it helps clear up some areas of responsibility. Unless the item was grossly misrepresented (this is a perfect boat) you'd have a hard fight.

could always try selling it to get back some of your money, as a fix'er upper.

Transom repairs are not 'hard' but its no cake walk, it depends on how much you want to invest into fixing it, but make sure you check everything else out before you attempt a repair
