Hey bigfish, congrats on the settlement. Yes, it wasn't everything you hoped for, and yes, Progressive should have paid for the storage and towing, but from their side they wanted to take it to a closer place and you wouldn't give them the documents they asked for right away. I am not saying they are right, but that is their side. Remember, there are always 2 sides to every story, mine, yours, and the truth! ;)

And yes, you would have thought the dealer would have cut you some slack on the storage bill. But, their side is, that is the price and you asked for it to come there, so why should they loose profit (which they will in the long run with that attitude, especially during an economic down turn). I mean, here is a guy with $20,000 to put down on a boat ... time to sharpen the pencil because it is $24,000 if I through in the towing and storage fees.

But in the end, you are free from the stolen boat, free from the payments, and you have some cash in your pocket. So, can I sell you a new car or truck? ;) :D

All this to say, yes, it could have been better, but it also could have been worse. The best thing is that it is over. And I don't think I will be looking at Progressive insurance anytime soon. Thanks for the heads up on how they work.

Glad for you that it is over.
I'd love to know who ended up with the boat title.
The dealer might well buy it from the insurance company "as is" for ....say...$3800-
BigFish, did you actually hand the money for storage to the dealer....or was that a direct pay from the insurance company?

Bigfish,

Did you buy this boat from this dealer? It seems kinda short-sighted to treat what has to be a very likely buyer this way. Not toooooo savy.

Good luck with the next boat and now you can relax!:D

Yes...that was the Hydra-Sports dealer I originally bought the boat from and I was disappointed he wouldn't budge on the bill after he knew that I was going to be paying for it. He just said the boat was taking up space and he had to charge me for that....I ended up with a bad taste in my mouth but it had to end somehow. Progressive paid the dealer and deducted it from me.

The dealer did try to buy the boat "as is" from Progressive but they asked too much money, something like 20k.

Anyway, all in all I'm glad it's over even though it cost me $5,800 more than it should've. But the way I justify it is that if I would've sold that boat today I wouldn't have gotten 21k out of it so... I think I came out ahead...

So, what are you gonna replace it with???? From previous posts I understand you are not in the position to replace it with an equal boat, but are you gonna get an older, smaller boat to hold you over till the economy turns around????

And just because you don't have a boat doesn't mean you are not allowed in the front door here!

Based on how Progressive acted from the start it is reasonable to assume you got the best deal you would have gotten. Too bad they dinked you around to get the this point. Now you know where not to insure your boat through, where not to buy a boat from, and where not to store it. Hard lesson....YES, but atleast you are free and clear from it. Have fun shopping for a new one when the time comes.

They just said they're not paying for it that's it... It's just another one of the many things they pulled on me. It cost me a nice radar/fish finder but I just didn't have the strength or desire to keep fighting with them.

I don't think I'll be shopping for a boat anytime soon. I definitely can't replace it with a similar boat and I'm kinda spoiled from where I was coming from. I really loved that boat, it was my favorite toy...

I lost a ton of clients in this recession so my future wife would kick my *** if I even mention the word "boat". I'm going to play it day to day and month to month and see how things unfold.

I have to tell you though that I really miss going out on my boat. I get sad every weekend especially when it's a nice day with 2ft seas. I imagine all those guys out there and it's not a nice feeling...

And that's exactly what insurance companies bet on. I've seen this scenario play out over and over again. They say the boat/car/airplane/whatever isn't totaled, you suggest that it might be, but accept the statement and take it to the most reasonable place to repair it. They refuse to communicate for months, jerk you around, stall, and then only start to give answers when an attorney is brought in. Finally, they refuse to pay for an expense that would have never been incurred, had they just dealt with the truth in the first place, all the while knowing the 99 out of a hundred insureds will give up when the fight starts.

Be glad you brought an attorney in - he is probably the only reason you got as much as you did.

That's pretty much what happened...

I could've fought for the $3,800 but at that point they had sucked the life out of me and I just wanted the whole damn thing to end. That's probably what they were betting on...

Still, it's shameful that I had to pay for a boat that was totaled which at that point belonged to them. I pretty much paid their bill...

If you want a bit of an eye opening educational experience, read up on Klecka v. Allstate. Aside from the dispute between the two, notice that Allstate did not notify its insureds that they had been defrauded in the overall matter.
