You raise a good point, Cruiser. Someone has to be designated--and capable--of dealing with the unexpected. I spend a lot of time on an island and even when the boats are tied up at night, there is the chance of an emergency run to shore.

that's pretty vague, eh? How is privacy defined? the cabin of a cuddy certainly counts as private? what about hunkering down behind the gunwales as you sip your beverage? What is "overtly displaying" it? What if it's in a Solo cup instead of a branded bottle?

It seems lax, at least where I boat, but I think if they wanted to make your day bad, the regulations would allow them to.

My wife and I were at anchor, catfishing on West Branch one night, a boat crept up on me by surprise, though it was just a passer by, suddenly spotlighted and we had a 4 pack of wine coolers 2 emptys and two opens, we weren't doing anything but sitting there fishing enjoying the evening, I was charged with posession of alcohol and fined $125.00.
Officer said my lantern sitting on the stern was not adequate for the 360 degree visibliblity rule and thats we he targeted me. You cannot argue with a law enforcement official no matter how the law is written, I thought it was BS but it is illegal to even possess it in an Ohio State Park.

Here is the reply I got from the Sherrif's marine patrol.....

Unlike riding in a car, when on a boat passengers can legally consume alcohol in Oregon waters. One of the things I would just caution you on is to make sure that you, or whoever the skipper of the boat is at the time, is monitoring the passengers if they are drinking. Alcohol has a different effect on people when on the water and passengers on a boat can, due to the inherently hazardous environment of the river, suffer injury or death when they make poor decisions or more easily be thrown from a boat when they are intoxicated.

in Florida, everyone can have a drink, but the operating Captain, must not be over the limit.

Nope... open container is legal in a boat in Wisconsin. .08 applies for the driver, .04 for commercial operators.

open container will probably get you an instant safety check, but it isn't a ticket.

Our local marine patrol on Eagle and Browns lake will ticket operator if they see them drinking. The retired one is a guy I see from time to time and he and I have had that conversation. He told me that even though he knew me well, if he saw me with a beer in hand I would get a ticket if underway.

When I was taking my Safety Course there was a guy who was in there for BUI. If the captain blows more than .08 you'll likey get probation at a minimum, mandaotry boater' safety course, and fines, and fees. He said that extra beer cost him around 8 grand when it was all said and done.
