Didn't I read upstream that you bought it with a 115?

I do have a 115 on my boat and yes it does power the boat although this is a heavy boat and the manufacturer is now recommending the 150. My problem is far more than the HP it the design of the pontoons causing the water intrusion. The manufacturer is now re-designing the hull because of its problems. My boat, along with others, were brought back to CS factory in GA. Unfortunately my latest calls to them have yet to be returned. I will call again tomorrow in hopes of finding out what they plan on doing including a time frame.....

The 'other guy' has a 90. So much for CS having a clue beyond skiffs ~~ and now that is in question.

I have the 115 hp also, not the 90. However, the problem is now beyond the power problems. If they are taking the boat out of production and reengineering it after one year, it doesn't matter what size engine is used. The problem is something much more serious, and at this point still not explained to the owners.

Question - if a car you bought was not being made next year because they were re-engineering it, would you expect them to give you a new one? People buy crappy stuff all the time and regret it, you know how many Berretta's chevy sold?

not that you get a new car or boat, but there's a difference between "crappy" and "inoperable." Not to get into the legal what-if's, but the UCC provides for them to get their money back when there is a total failure. It's a hard decision if there is an alternative of getting the boat back corrected, but it's an option.

I fear you'll have to lawyer up to get the results you seek.

I do not want to wait for a year.....I have already lost 1 year of use......................Carolina Skiff needs to "step up" and address this issue now...................................

They are. And not really anything you can do about it. You will just have to wait, unfortunately. As long as they are addressing the issue, there is no "complete by this date" timeline
for CS. They will do what they can, but the more impatient you get, the harder the wait will be.

when you talk to a lawyer about this, he will (should!) consider the effect on your remedies by being so patient. Sometimes it helps, sometimes it hurts, but what's going for you is that it's winter and you probably wouldn't be using the boat now anyway. When someone claims a car is unacceptable but drives it daily for 8 months, they kinda prove themselves out of court--not always but it's an issue.

Just be sure your lawyer understands article 2 of the UCC, rescission and the warranty of merchantability. If these are unfamiliar to him, change lawyers. Beware the ones who say "Tell me your problem and I will tell you my specialty."

Well, they have your boat, and it sounds like a few others. They KNOW they have a problem, and upset customers. So they are trying to fix it some way.
Until it is fixed, tested , and is deemed by CS to be an adequate fix, then and only then will they give you an update. Basically, if it's not fixed, they have
nothing to tell you about.

They have been aware of most of our problems since we first put the boats in the water last spring. But right now their fix seems to be to "reengineer" the boat for reintroduction in 2015. Doesn't really help when the summer of 2014 finally arrives.

You can ratchet up the pressure a bit on social media. CS has a pretty heavy following on Facebook.
