Deposit refund question

After looking for a new boat i saw a nice one on ebay from desription and pictures it seemed nice.I contacted seller and he agreed to end auction early for my price.i sent hima 500 deposit to hold boat.
When i went down to look at boat it was junk painted with auto paint the trailer was in bad shape totally differnt then what seller said
I told him i dont want the boat its in bad shape,he said soon as he sells it he will send deposit to me.
Well now he says ct law lets him keep the deposit and he wont give it back plus i think he sold the boat.
What would you do?

Small claims court. But -- Ebay rules may work in your favor if the product was grossly misrepresented.

Contact Ebay, He misrepresented the Item! Plus if you sent deposit thru Paypal you can dispute it thru them too...

The first thing I would do is ask myself why I did such a dumb thing in the first place - why would I give anyone $0.05 for something I haden't seen with my eyeballs. Then as others have said try to get relief from ebay and then small claims court. You may have to eat it as a lesson learned if the seller stated "as is where is" or something simular.

if you didn't use pay pal you are screwed. you got him to end the auction early. you agreed to buy it. do you have any proof, it was on approval of visual inspection.

If you agreed to buy it outside of ebay, you're screwed.
