Was the starter a brand new OEM starter, or an aftermarket?
I have run into a lot of this with aftermarket starters lately. For 20 years I installed new OEM starters and never needed a shim. Now I have to use aftermarket starters (New ones even) and have to shim them on occasion.
So that may be a problem, and if the ring gear is now damaged, time for a new one. Just make sure you have the proper clearance on everything after putting in the new ring gear and starter.

Thanks all, I got a plan, thanks! let ya'll know the results. In wrestling season so i can't touch it for three more weeks. but after that my life turns to this boat.

the brand is ARCO. They say they are pretty good. I have a friend that does starters and he says they make good product.

They do make good starters, and I had to shim 2 out of 4 of them last year on 3.0L engines.

right out of the box everything worked great. It was after the botls bent that I've had this probelm. Even after I put new bolts in.

Any grooves worn in the aluminum housing of the starter?

NOPE, the gear comes out straight. I thought about that and did a bench test of the starter. However i'm thinking about having my friend who does startes rebuild the OEM one and put it back on. If the bracket does not work that is my next thing to do.

check the thickness of the stsrter thru the bolt holes, I have seen aftermarket starters that are enough thinner that the bolts bottom out before they clamp the starter tight to the block, the fix is washers under the bolt head. good luck
