Tell the conservation office to come get their damn fish out of your pond they are trespassing. Or if you have to let people fish the pond tell them to do it by helicopter cause they cannot cross your land. Sounds like a BS rule that needs changing

I'd bet you could call the police and have them removed from your property. If the cops don't know anything about the dept of conservations laws (and I'm guessing they don't) then if you say the fisherman refuse to leave your property, the cops should clear them out.

Maybe you could just beat them out of $4K in a poker game and they will go out of there way to avoid you so they don't have to pay!!:p:p

Require the state to carry liability insurance on your property to allow people to fish it. Or require people to sign all kind of paperwork to release you from liability........Have some friends come over and fish it so you can say it gets some pressure even if there are no hooks involved.
I really don't get it.....you don't have to let hunters on your property, BUT you can't keep fishermen off.
Have the conservation officer quote the statue and then ask a lawyer.
In my experience conservation officers don't necessarily know the law and on occasion make it up as they go along.

I suspect they'll be back soon, probably with a copy of that letter you got and a truckload of their friends. Keep the conservation officers phone number handy so that he can explain to them the "I-don't-like-the-way-you-look" loophole. Better yet, see if he will fax/email that to you in writing. Once you're done with these Jr. Matlocks that will probably be the end of it.

If they ever figured out a way to force you to let them fish there, sein the pond & give the fish away to the needy and then zap it w/rotonone. When they show up, let them fish their little hearts out.:D


In MS a possum cop can come onto your property and check your fishing license and your catch/limit while you're fishin in your pond, so they've told me. I never heard of them enforcing it though.

No boobytraps. They always end bad.

Mark off the area around the pond....add helicopter pad....mark the rest of the farm no trespassing. Technically you're not keeping people from fishing the pond....they just have to have the right equipment...

Those with helicopters can fish as they please.

Look for an attorney familiar with conservation law and find out what can be done. Anything else will just end up in frustration, fighting and bad feelings. Might get some "payback" from the yahoos you turn away. Best to do it legal. Then post the results so people know they can't fish there anymore.

That's just hard to fathom. What congressman in their right mind would have ever voted for that law?

It would be too late for your situation, but it's a shame a state rep with some backbone wouldn't get that law changed. It's just hard to find many that are interested in owners rights vs. the "common good."

The simple solution is to tell everyone who asks (or just shows up) that you don't want them on your property. Don't give a reason or say no fishing, just spell it out clear and simple.

I would suggest writing your local state rep. for help. It's a bad law.

Your right that is a weird law. I think you need the state to prove were the fish came from. Until then no trespassing signs would be the way to go.You can fish all you want but just cant step on my land.

If I were in your predicament, I'd hire someone to poison that pond in a heartbeat. Just make sure that there is not some equally screwy law, that would make you pay for killing the damn fish.

Put up a sign sayin "Fishin by appointment only, no trespassing without permission"...leave the number for the local fisheries director.

Never take an appointment.

I'm figuring the problem will disappear real fast when it costs the fisheries director time out of his day to reconcile.

I suppose an option could be to net every single fish in the pond and, having been notified they all belong to the state, return them to the office of the commissioner. If he doesn't answer, leaving them on his front step with a few news cameras present might be a good second.

on a serious note. Don't do anything and see how bad the problem really is.

A stocked and untouched private pond is like finding buried treasure to a fisherman. Maybe if you are going to kill the fish anyways you could have a fishing tournament with an entry fee. Let them take as many as they can before you kill em, and maybe raise enough money to offset the cost of killing the rest.

Your problem here is not really with the fishermen. It's with the law that gives the fisherman rights to your property. While it might be easier to go after the fisherman than the law, it isn't the right thing to do (even though the law doesn't seem right either).

I have a problem with any law that grants people rights to others property and anybody that thinks they are entitled to access to private property.

No, they don't "think" that they are entitled, they are entitled. Which is why the problem is with the law not the fisherman.
