One needs to ask himself "What will keep you from fishing in a location?

Me: Steep banks
Shallow water
Underwater obstructions
bugs

If it was my pond (and I didn't fish in it) I would load that thing up with as much brush as I could. Nothing like loosing your rigging every time you cast out. Just make it impossible for them to fish. You can always drag the stuff out later on once things quiet down and the talk gets out that your pond is a disaster to fish. Good luck........SS

Maybe you could put up a sign saying "danger poison in use" Let them figure the rest out and wonder if the fish are safe to eat. The poison you could be using might just be a few drops of weed killer used on some crapgrass a hundred yards away,,,They wont know and its legal for you to do.

I can't believe the state would actually allow you to poison the fish. The people of the state own them and yet they want you to kill them all off before you stock with your own fish. That is almost as bad forcing you to let people onto your property

Put up a fence around the pond(within a foot of the shore) and allow only access to the pond. Post the rest of your property.

This is amazing, but not surprising.

I have land also, with three ponds on it. I have had nearly constant issues with hunters and neighbor kids with dirt bikes who think they should be able to use my land as they see fit. Last year the neighbor lit the pasture on fire early spring with his dirt bike. This year he called the cops because of smoke when I was doing a controlled burn. Keep in mind he lives a mile from my house and has 90 acres of his own.

A few years ago my FIL took out some woods about 70 yards thick along a small creek on one side of his bottom ground. He probably didn't go within 20 yhards of the actual creek. The corps of engineers said he wasn't allowed to do this because it was a "navigable waterway." I'd think you would be an idiot to put a canoe in it during spring. He was fined over $10,000.00 for this.

I am amazed that they can get away with doing this stuff.

BTW an old mattress spring is the best lure trap known to man, tie a rope to it and pull it up every fall for an endless supply of free lures.:D

Oh yes, the wonderful Corps of Engineers. Many moons ago I beat them at their own game.

I owned a farm right on the Mississipi river (Just north of Bellevue IA) and had a small creek running through my property. When I say small I mean it had maybe a foot of water in it most of the time. I wanted to dig it out so I could put a dock in the creek.

I was told no, its a "navigable waterway" because it empties directly into the river. Umm, are you kidding, no way is that navigable. Their reply was yes it was, by flat bottom boat for fishing, blah, blah, blah.

At the time I had a jet drive boat and I had an attachment for it so I could hook up a 2 1/2" fire hose to it. On a Friday afternoon I borrowed a 100' of hose from the fire house (I was on the volunteer department) and nozzle. Pulled the boat up close, hooked up the hose and had the neatest "water mining" rig you ever seen. Over the weekend I used it to wash out the creek until it was about 4' deep, 15' wide and maybe 50' long. My boat pulled into it nicely and I parked it there with a tie off to land.

Sure enough the following Monday the Corps came by in their patrol boat, seen the creek and here they came. "You can't dig this out like this and you have to put the dirt back or else..." Umm, guys, I didn't dig anything, do you see a pile of dirt anywhere? Well someone dug it out!!! No, I "navigated" my jet boat in and out and the jet seems to have cut through the soft silt/soil.

Yeah, they were POed but as they said it was navagible there wasn't a thing they could do. A month or so later I put my dock in on my land and canterlieved it over the water enough I could pull the boat up. When I sold the farm the inlet and dock was the thing that sold it for the price I wanted. It was about the only private dock on the river for miles in either direction. :D

I'm sure everyone downstream appreciated the runoff. But hey--when you're "sticking it to the man" then anything goes, right?

Sorry to say this, but what you've described seems incredibly irresponsible to me.

Have you see the Mississippi? Ever seen it after it rains? Do you really think that little bit of extra dirt hurt anything?

We're not talking a spring creek in the rockies here :rolleyes:

How much time have you spent on the Mississippi? Not much by the sounds of it. You should see what happens when a tug pushing a dozen loaded barges reverses its engines to stop the barges. It kicks up more mud in 5 seconds than I could move in a year. Yes, there really is a reason its called The Big Muddy.

There is a lot of truth to that. Obviously he has no clue what the Mississippi River is famous for, the tremendous amount of sediment that is deposited at the mouth!

Because almost 550 million metric tons (500 million U.S. tons) of sediment are deposited annually, the delta extends about 91 m (300 ft) each year.

Hmm. Not a very friendly response, now was that?

I've read enough Mark Twain to know what's up with the Mississippi. I also know that if there's a rule against digging out the banks of a stream on your property, it's probably there for a reason. Sneaking around a rule in this way to improve property values is not something I approve of. I can think of a lot of laws and rules that I disapprove of, but I still follow them.

I would suggest that neither of you have been very neighborly like. Many things are a question of degree . . . If this mud runoff came from a hose while working on an unrelated project would that be OK? Would a backhoe be OK? I would submit that either extreme might trigger different responses.

BTW, this Mississippi mud discussion is a hijack . . . let's get back to the pond K?

I'd bet you could call the police and have them removed from your property. If the cops don't know anything about the dept of conservations laws (and I'm guessing they don't) then if you say the fisherman refuse to leave your property, the cops should clear them out.

Maybe you could just beat them out of $4K in a poker game and they will go out of there way to avoid you so they don't have to pay!!:p:p

I can confirm that! Obviously police are different here in Minnesota, but at least concerning this matter - they aren't. I was pulled over last fall on my ATV, well not really pulled over. I was riding and ahead of the trail there was a county sheriff and local police officer waiting in their patrol cars for me. (They must've known I was there?) Anyways, the sheriff asked for ID and so I gave it to him and while he was confirming my identity with the sheriff's office over the radio, the local cop that I personally know got out with his deputy and was asking me if I shot any grouse that season and whatever.. he seemed clueless, as he didn't even tell me what I did wrong. Then the sheriff comes over and actually tells me what was going on.. (didn't have headlights on, clear SUNNY day as well. Weird regulations here) and so the cop is just like "yep..mhmm..uh-huh". :p So to make a long story short, local police don't seem to know any "outdoor regulations" just watch out for the sheriff, because I was pulled over by the head-sheriff the year before for a similar reason. Luckily it wasn't on my record or anything haha because he said next time I get pulled over he will come over and personally seize my ATV. :rolleyes:

If the previous owner had the pond before the mentioned law came into effect, couldn't that pond be grandfathered in since it was there before the law?

I would drain the pond take ALL the dead fish down and leave them on the courthouse lawn. And tell them Here's your damb fish now keep them out of my pond. Or maybe send them a bill for "Fish Maintenance" !

According to the off the record conversation I have become a thorn in the side of the conservation department and it was hinted that just maybe that is the cause of the current situation. :(
