Cars, even 'Stangs, can be replaced or repaired.

Glad to see that you are counting your blessings.

Make sure you take that exact attitude with her insurance carrier. Also make sure to remind them at least 3 times that this is all her fault. And no matter what value they put on the car, insist that it's worth at least 50% more. That will make your claim go as smoothly as possible.

I hope she got a ticket for being at fault. The claim process will be to your advantage if she did.

Who gets a ticket and who doesn't has very little impact on liability investigations. What the police report actually says, and the driver's statements are what matters, not a ticket.

So let me guess-- was she talking on her cellphone or texting? I was driving with one of my sons in the car the other day and a woman paying 100% attention to the message she was texting crossed over the median and almost sideswiped me. I had to swerve out onto the shoulder to avoid her. I don't think she even noticed.

Based on my personal experience, I stand by my statement.
Please note, I did not imply, a citation is the "Be all/End all"

It's not rocket science here. Insurance companies will avoid paying claims whenever possible. They play the "at fault blame game" as well as anyone. A motor vehicle citation, can very well be a factor in which company pays the claim. It was, in my case. Not only did I avoid a hefty rate increase, the $500.00 deductible was waived.

And I stand by my statement based on 10 years as an Auto Damage Appraiser, in the insurance industry.

A car can be replaced. The boyz are o.k. THAT is what matters.

The girl "said" she was only going 10-15 miles per hour. YET both cars are probably totaled. (At this point it appears ours is anyway). YES, she got a ticket for failure to yield. HER insurance company has already admitted to being at fault.

What I was getting at, was that NOW, we have to wait and see where it all ends up. I am NOT a patient person, and never have been. I have NOTHING against insurance adjusters, or insurance people in general.

It is ALL a TIME game to me !!!!

Understandable. The company I worked for would already have a check in your hand for a total, or an estimate for repair. But that's a company that has EXCEPTIONAL customer service. Most big companies take 4-5 days.

What makes you so certain your vehicle is a total loss? Is the damage really that bad, or is the car worth so little money, that a scratch on the fender would have totalled it? ("Scratch on Fender, Obvious Total Loss" was a statement I would use to our claims reps, when describing a total rusted out car involved in a minor accident. Just a way to lighten the mood between co-workers.)

Re: Grrrrrrrrrrrrrr

The body shop said that the thing is "sprung". There is ALOT of strut, suspension, and front radiator support damage, the hood, (I was told that was $1,000), so the body shop (a FORD shop), says it is totaled. I don't know. I'm taking their word for it.

Re: Grrrrrrrrrrrrrr

Ok. Sprung is not a "real" body work term, but I know what they mean. You have some structural uni-body damage to the front core support and the left fender inner apron, maybe even to the left lower unirail. Depending on the severity, it can all be pulled back out on a frame machine. Suspension damage on a Mustang isn't real complicated, as there are only three main pieces, the lower control arm, the strut, and the steering knuckle. However, with the exception of the strut, the other parts are Hundreds of dollars and pay a minumum of 3.5 hours to replace. The hood is fiberglass, if it's $1000. However, since it is fiberglass, it will be readily available in a salvage yard (no rust or dings to deal with, since it's not metal), at about 50% of the cost. However, it would still need to be painted and installed.
If the core support is damaged badly enough to warrant replacement (and since they are just really thin sheetmetal, it doesn't take much), and there is actual suspension damage, what you are describing is easily $5000 in repairs, possibly more, depending on the actual severity.
