First, to Mark42, easy on the generalizations. be t90% on this forum couldn't last a week in my wife's state job. She takes care of disabled children in school. You'll be gone after the first time you change a 7 year old's diaper. The one man that did work there lasted 2 weeks.

Back on subject, document, document, document, talk with lawyer, document.

I had a guy working for me and he just quit coming to work. Quit coming to work. Tried to get him to come in for 2 weeks (he had passwords we needed). He would not come. HR notified him he had abandoned his position. This was actually covered in the employee handbook he signed. Well the Federal judge saw it his way. Apparently the only recourse we had for his failure to tell us he was quitting was to ask him to tell us he planned to quit.

When an employee sues for wrongful termination how many on the jury are people that don't work themselves? There's a bit of irony.

I always say "people don't get fired"
"people get themselves fired"

Its easy to fire somebody and i've never felt bad about it. On the flip side its very, very emotionally hard to lay somebody off not because of their work but because the business is just slow/downsizing.
you took the words right out of my mouth. I have fired or been involved with at least three firings in the last month and I have not lost one minute of sleep over it. all were given the verbal warning, then the written warning and still chose to screw up.

Its rarely enjoyable to have to fire someone, but it goes with the territory as a manager, officer or director of a company. When people screw up again and again, sometimes they just have to go.

That said, not every employer is fair and not every employer makes good decisions on this matter. Some are full of hacks who seriously abuse the definition of "manager."

Documentation is the key on both sides of the issue. If you're right, no matter what side that is, you usually end up OK.
