HELP....Used Boat- Cracked Block-Question

2 months ago my husband bought a 2 year old Domin8er boat ($35,000) and purchasd a 3 year warranty for $2,500 from an out of state dealership. He just took it to a boat repair shop in our town and needless to say once they replaced some small part in the engine they said they noticed the block is cracked. The repair shop called the warranty place and they said they would replace the engine if there was proof that the cracked block was caused by something "internal", otherwise we would be out another $8,200 for the engine replacement. My husband has had a boat his whole life, so I know he knows how to winterrize a boat. So, my question is what else besides not winterrizing a boat correctly could cause a cracked block? I don't know if the repair shop will work with us to utilize the warraty since we didn't buy the boat there. I'm sure the engine was cracked before he bought it but even the repair shop guy said until he got into the engine he wouldn't have known it was cracked. If the repair shop and the warranty company doesn't work with us to get the engine replaced under warranty, could we hold the dealership liable for selling us the boat under false terms? Any information/advice would greatly be appreciated.

Warranties do not cover freeze damage. Any competent mechanic can tell you if it is freeze damage or a thrown rod or other part that would cause a crack. You would know though if it failed mechanically and that failure caused the crack. Sounds like who ever winterized it, was not familiar with that motor and missed something. Bummer. The dealer is going to say, sorry, it was winterized and worked fine when you purchased it. Did you take it for a sea trial or get it inspected by a mechanic before writing the big check. If you did you could go after that person for missing something as basic as a cracked block. If not, you just learned a very expensive lesson about buying a boat and not getting it checked out, and or not winterizing it properly. Short of a rod breaking I cannot think of anything else that would crack a block. It must have some motor in it if you are being quoted $8200.00 to fix it. Otherwise someone is taking advantage. More info is needed to clarify that though.

This will probably go to court.

The block could have been cracked when you bought the boat but I doubt that, there are numurous things that could cause that but how you would prove any of them I don't know.

Probably the most common cause is water freezing in the block, which is what they will say happened and is likely the cause.

I would try the dealer you bought the warranty from that is probably your best shot but they write those warranties to exclude almost everything that could go wrong except where they get inot your wallet.

Does the crack leak water, has it been sea trial or pressure tested? I have what looks like cracks on my block too but it's never leaked.

I'm not understanding why your husband winterized it himself? For $37500 I wouldn't be doing jack squat to it myself during the warranty period. I also want to know why the heck kinda engine is in there that costs over $8k to replace. I had a Jasper 350 put in my truck last year for $3600.

Different perspective.
"Two months ago" would be January.
Anyone buying a boat in January should be able to expect that it had been winterised properly before they took delivery.
I would think that there would be a reasonable claim against the dealer.

But....Bondo's question "Did you run it at all after buying it,..??" was never answered....and if it was, it's a different story.

I second that thought. If you bought it in January and have not had it out then you go back after the dealer you bought it from. They should have winterized it and had it all prepped for storage.

What part of the country are you from? Is freezing even an issue?

Also, we had a similar (sort of) issue on an old Rinker we had. The crack was in the water jacket and did not affect the engine at all, other than a VERY SMALL leak of water down the side of the block.

I want to know where this boat was/is located. Domn8er is a CA local manufacturer and typically not sold or used outside of CA, AZ, NV . . . Where is this boat? Where was this boat? I don't winterize at all here ;)

I read it as her husband knows how to, but she didn't specify if he did. The fact she said he knows how to, leaves me to believe he did, or else they wouldn't be questioning his winterization abilities.

Call the dealer and explain what happened to them would probably be my first plan of action.
