I wish I could move the pool...Small yard and the pool has to stay where it is... I understand the "its not your property" thing, but ive been watching the house and I think its vacant....If I could contact someone I would for sure...But with the swimming season around the corner time is of the essence.

Tordon....most farm supply stores sell it in small bottles. all you need to do is take a hatchet or machete make a hack all the way around the tree....spray the Tordon on the hack marks and with in a month or two the tree will be showing the signs death and disease. I use it on gum trees on my place.

Trespassing and vandalism should get you a nice stiff fine and maybe even civil damages. It is their tree, not yours. Killing it would be like poisoning their dog, and very illegal.

Your rights end at the property line. Cut off what encroaches and live with it.

That tree is NOT yours to kill. All you can do is trim what is over your property. You really need to track down the owner and get their *written* permission to remove it -- shared expense or at your expense.


BTW - just killing the tree is not really going to help a lot. Dead trees drop a lot of twigs and branches that can be just as irritating. And a dead tree can be much more dangerous. Killing a tree and leaving it standing can create horrendous liabilities for you if/when it (or any of its branches) falls -- that's in addition to liabilities and penalties for killing / cutting a tree that's not yours.
