You said "Nobody was hurt". Have you said that in writing or on any report. I would check with any/all passengers now and ask if they might have some kind of problem that was not noticed at the time of the accident. If there is make sure they get medical attention.

You might pass this on to your attorney and it wouldn't hurt to let the other insurance company know that you have some concerns about injury to your passengers. That might help in your dealings with them.

SoLittle has a good theory but it might be one of those "what comes around goes around "deals. A few years ago I sued Beverly Health Care, a Nursing home in Arkansas b/c one of their vans pulled into a hospital parking lot and hit my car while I was sitting still waiting to pull out. the driver blamed me for hitting her, to save her job. I filed for about 70$ in small claims court in the county where it took place and settled out of court for more than my car was worth and got a check 3 weeks after the wreck. The max is 5k in small claims and I don't know if your boat is worth that so you can work out details relative to that. One thing you can do is find a local attorney there who gives free over the phone advice and they can tell you some basics about your small claims steps. The phone answer's I've talked to here about that stuff (not my only time)seem to like giving advice about it. Let's say you are trying to recoop 4k in damages or a check. An Insurance company who knows they may lose the case in court won't go to court. they may threaten to have the case escalated to circuit court to see if you back off( maybe that's happened, you weren't clear) but just stand your ground and have your witness

I won’t fake getting injuries. I will however make sure he gets a conviction, court is 10 days away. you should see the $$ they charge for court cost. I just got this boat in Feb 2012, I do think I should get reimbursed for Fox Waterway stickers ($92a year), plus tax, title, new IL Reg, and. I have $3000 in the boat. And what about the time off work to go to court because he chose to lie.

What are you jumping all over SoLittle for? He didn't say to make a false claim. He said to check with the passengers to make sure that no one had developed any problems in the time after the accident. With the amount of damage there was to the boat there could be neck or back injuries similar to what can happen when getting rear ended by a car. That type of injury isn't always apparent at the time of the accident.

As an example. My friend got hit by a car in a parking lot one Friday evening. He went to the hospital to get checked out and they said everything looked fine. He thought he just had some sore muscles. He went back to work on Monday and was able to work for about 2 weeks before the pain got so bad he couldn't hardly walk. Right now he's recovering from back surgery for two ruptured disks.

If anyone has developed problems since the accident, then that needs to be brought to the attorneys attention.

Stop it with the "check for injuries" stuff, please. "As hard as the boat got hit", it's probably no harder than 25 wakes he crossed that day.

Yeah yea yeah, everyone knows a friend that got hurt real bad, this and that, but it doesn't happen often. I jumped on SoLittle because that's what everyone does, tries to imply there might be injuries, when there isn't.


Your title costs on the next boat should be paid. And if registration can be transferred, it too. If your waterway sticker has a charge to transfer, that should be paid as well. But you won't get re-imbursed for the whole amount, because you've already used part of it.

4321 and I still have a trailer to sell.

So they paid for a sticker and slip rental that they didn't owe, but not your title or registrartion transfer that they did owe? Strange.
