Is it legal for my brother to mail/fedex me pistol in parts or whole?

I'll be flying down to S. CA. next week to visit, can he mail me the pistol in parts - separate packages??

Everything can be mailed except the frame that contains the serial number. Get caught mailing a serial numbered frame without the proper FFL and you will get in some big federal trouble.

He can ship the entire gun to a FFL holder in your area and you can pick it up from there.

Only Manufacturer's can accept weapons via mail.

My brother is a FFL manufacturer and keeps me straight ;)

Not really. He can mail you everything but the part with the serial number on it.
"Knives, air guns, accessories, and most gun parts need not be shipped to an FFL holder. We say most gun parts because each firearm contains at least one part that the ATF considers a firearm. This part is typically the part that contains the serial number. This part must be treated as a complete firearm when shipping the item."

Its a real shame, and I remember the days, I sold and shipped a S&W .357 complete on ebay and shipped Via USPS Priority mail!

Even better...that way, when he gets popped for transporting weapons over state lines, he's the one who gets to deal with the authorities!!

For you to get into trouble by FedEx, it would have to get discovered that it was a firearm. I would be more than tempted to remove any ammo, clips, grips (whatever disassembly you're comfortable with), pack it securely in foam, and ship it.

With the job I do now, I can tell you, most of the packages FedEx and UPS ship there days goes through a metal detector and are inspected if there is a hit without a disclosure..

The days of shipping a gun, person to person without a FFL have come to an end, I hold a FFL and I have to ship to another FFL holder or I violate Federal Law and would expect a visit pretty quickly after attempting to ship a gun.

So why don't you just fly with your firearm? as long as your not trying to fly with Ammunition, it's really not to difficult....declare it in checked baggage in a locked hardsided container then when you get to your destination make a stop at wally world and buy a box of ammo....

If you talk to a local gun dealer he will probably receive it for you for 15 or 20 dollars. Go to gunbroker.com to find a local dealer. Good insurance against jail time....gm

I have to say air guns can be shipped to private party, how do I know this have had 4 shipped Fed Ex to me in the last year. As far as firearms not sure I buy them in person. Do know that some guns can be shipped such as black powder. There is a large mail order buisness in these.

There is a big difference between a firearm and air guns and muzzle loaders..

Not true Lipp. And I quote from the TSA website:

"Ammunition may be carried in the same hard-sided case as the firearm, as long as it follows packing guidlines described above"

I printed out a copy of this to take with me on the airline.

Incidently, here is a web link for the best, smallest locked hard case that I have found for storing a handgun in stowed luggage. Everything else I found was way too big.

Oh I agree with ya Boom all I am saying is that the horror stories I know of have been related to flying with Ammunition, I don't remember hearing anything outrageous about flying with a firearm...but I could be wrong too

yeah and I just read you can transport a firearm on a plane - on checked baggage, in the cargo hold, maybe I;ll call Southwest and ask

You can fly with a firearm in your checked bag. It has to be in a lockable hard case (obviosly unloaded) and you have to declare it upon check in. If he is going to drive with it he needs to travel with it in the same type of hard case and seperated from the ammunition by a good distance. (i.e. pistol in the car, ammo in the trunk, or vise versa) Being from CA oroginally I know the regs. Even though the weapon is legal in that state they will still make you fill out a bill of sale if you ever wish to register it in that state. My advice,....CA sucks, get out of that state and have some freedom
