Re: Is this a Hate crime?

So the rape of a 6 year old should carry no different penalties than the rape of, say a 24 year old? No "special" laws you say.

A lil' emotion ta make yer point BB? Still not a valid cornsideration if justice is to be "blind". A crime is a crime. A protected person is a protected person. Emotion is for sport not the application of law that can take a person's freedom away with the awsome power of the State paid for with yer own tax dollars. Respectfully, JR

If this is true I think this prosecutor, as well as the lying stripper, should be brought up on hate crimes.

<<The prosecutor in the Duke lacrosse rape case insisted all summer that he had provided all the evidence, then unloaded thousands of pages of raw DNA test data last October, a defense lawyer testified Thursday.>>

<<By studying that data, the defense learned for the first time that genetic material from several males had been found in the accuser?s underwear and body, but none from any lacrosse player, defense attorney Brad Bannon said at District Attorney Mike Nifong?s ethics trial>>

Motivation behind the crime is irrelevant, the crime itself is what is important.

We are way to soft on these criminals. We should eliminate all "hate crimes" and make the softer sentences eqaul what the hate crime sentence is.

Stealing is stealing, doenst matter if the victim is black, disabled, or Donald Trump.

Re: Is this a Hate crime?

Let me clarify my point.
The guy was dragged to his death BECAUSE he was black. It would not happen to you in that case.Special punishment is an important part of the law, since it takes motivation in consideration.
As for your drug dealer. If he sold drugs to minors, than that should be taken in consideration and he should be punished accordingly .(personally I would like to shoot the bastard).
Your Paris Hilton example shows that we cannot make the law for sale and I agree with that.
There are no special laws for any kind of group. There are special laws for special crime motivations.

You can't say he was dragged because he was black, because that was never an issue in the trial, and has never been proven.

Makes absolutely no difference if the perps were charged with a hate crime. They were already charged with a crime, that was punishable by death.
Charging them with a hate crime enhancer would have put more of a burden onto the prosecutors, with absolutely no chance of changing the outcome of the trial, or the sentence.

Re: Is this a Hate crime?

Originally I had no problem with Hate Crime legislation. I thought I saw clear delineations. The Slippery Slope never seemed to enter into the picture...until now. :(

:)

The slippery slope has come into play in many cases already.

The one that comes to mind as being plastered all over the news media, was the case of the young gay man killed out in Idaho? a few years ago. Hate crime against gays was all we heard for some time. But then it turns out he was killed for some totally different petty reason.
