Get this mercury took Yamaha to court for (dumping) Tax or overselling Yamaha motors,to the USA than keeping the same price as sold in Japan. Long but intesting story, never the Less Mercury has been buying Heads for there motors 4 or 5 years and all that you see on the tv mercury is #1 on the water,BUT saying that why have they not (merc) mention that Yamaha is keeping them that way? Never the less A question was asked to merc, attorney's what about all the ones you have bought on or around the black market's to avoid taxes and other sales. SEE KIDS IF your going to rat on someone try to remember not to be a rat yourself!! Thank you Mercury for using our court system for your trash hole. Keep up with the rest or sell out! ;)

I think its a merc bash, but its hard to tell.<br />in fact my head hurts after trying to read that!

I believe he is eluding to the ongoing court battles between Mercury and Yamaha. <br /><br />Yamaha was found guilty of "dumping" product in the US. As many of you know, Merc. buys allot of engines/components from Yamaha. Because of Yamahas preditory pricing, Merc could not compete with nearly the same product. Merc proved their point and won the suit.<br /><br />This is not the first time that Yamaha has been in US court and lost. They lost an enormous patent infringement battle to OMC in the early eighties.

Yes, Yamaha tried to create the "perfect" engine by building exact copies of Johson/evinrude.<br /><br />And, if it wasn't for Yamaha, merc would not have a 4-stroke except the Verado.<br />Look for a MAJOR increase in price in merc 4-strokes.. :rolleyes:

Mercury's case for dumping was based on the difference between what Yamaha's price to it's dealers in Japan was versus what Yamaha's lowest price was to OEM Boat Builder accounts here in the states. OEM accounts are boat builders not dealers. Japan's home recreational marine market is not tiered like ours are. They basically go Manufacturer-Dealer-Consumer. We now have a Manufacturer-OEM Boat Manufacturer-Dealer-Consumer structure. Mercury's complaint was ruled to have merit back in August and is still under review by the Feds for a final verdict. The ruling effects ALL Japanese outboard manufacturers equally. If the dumping charge sticks then they all have an additional 22 percent duty leveled on them. In addition to deciding if there really was dumping, it has to be proven that the dumping has actually harmed Mercury. That's not going to be easy since they have continued to gain market share ( with the demise of OMC all the rest of the manufacturers gained , but Yamaha gained enough to worry Mercury) and post profits. Based on the data that I have seen and the testimony that I have read, Mercury's complaint will be found to be....inaccurate and the temporary duty will be done away with or greatly reduced.

Only Mercury understands why they brought this mess up. Right now Mercury doesn't have a snowball's chance in you-know-where to meet the EPA guidelines without Yamaha. They shot themselves in the foot bigtime with this debacle and their reputation has suffered immeasurably, as has their relationship with Yamaha. Easily the biggest blunder in the marine industry in decades! I wouldn't advise buying any Mercurys with Yamaha parts. That includes all 4-strokes except Verado. I expect an ugly divorce in the very near future.<br /><br />The retarded thing is that once Mercury got duties imposed, they wanted to magically be exempt from those charges to buy Yamaha powerheads so they can paint them black and call them Mercurys. Now that they have to pay more for Yamaha stuff they're crying about the cost. IDIOTS! What's good for the goose is good for the gander! If the consumers have to pay more, why not Mercury? WAKE UP MERCURY! Get yourself a legal department with a brain.

Mercury jumped on with Yamaha.OMC?BRP jumped on with Suzuki to give us 4 stroke engines we told them we wanted.Neither liked the alliance,both created their own engines,and now want to sue Japan for dumping.... go figure.Now try to get parts.Reasonably priced.Or parts period.<br /><br />DHP<br /><br />sorry,I don't think BRP is suing (got excited)

It is funny (maybe not so funny) how in 1983 OMC and Merc owned the US outboard market. In less than 20 years OMC goes Kaput and Merc and Yamaha or at odds. I was in Cozumel Nov. and 99% of the 0/B were Yamaha....Get it together Merc.

Today's the big day! The feds are supposed to rule today on the impact of Jap outboard dumping(?) Lets see how much engines will go up in price.

Well, I for one hope this means an ugly divorce as I want to see the US companies outdo the Japs in the future. I have faith we can out do them at their own game, stealing technology and making it better. I think Evenrude has come up with a good motor to go against them and I KNOW Merc's Verado will make them go whimpering unless they steal that technology too. Of course I'm biased as I own a Merc Verado and I am retired US military.
