I think you guys on the right, and all the talk radio mouthpieces, need to take a serious refresher course in the constitution, and what it means!

I don't need a refresher course.....First of all the Constitution establishes how the governmental process is to work. NOT establish rights. That is outlined in the Bill of Rights. Secondly to understand the Consitution you need to read and understand the Federalist Papers. Its like a Cliff's notes version to what the true intent of the Constitution verbage. Its been referenced by the Supreme Court more times than the Constitution itself. Thirdly, rights are reserved for law abiding citizens of the United States, not enemy combatats nor people thirsty for treason. Finally, the Constitution nor Bill of Rights details how to treat "terrorism" since it was not an issue of the time, or even a vision the Founding Fathers could forsee.

Conservatism is based on protecting "the establishment". Rome was the first true Republic/Democratic society which ultimately fell because of liberalistic ideals. History does not need to repeat itself.

Another case of changing the subject when the subject doesn't support your agenda. These guys (Haut and the rest) can't acknowledge the truth in the statement that this IS NOT good for the Dems POLITICALLY - so they change the argument to be about their concerns for liberty and freedom etc.

The fact that was stated is that this is a win for the Administration (Repubs) and it follows that as such it is a loss for the Dems for the litany of reasons already cited. It's as simple as that - regardless of the other issues which WERE NOT part of the original assertion.

You don't have to agree with the statement, but at least have the intellectual honesty to take this battle lost in stride. You may yet win the war, but this particular battle is most definitely a loss for the Dems.

I did, however, learn something new! I learned the Bill of Rights was not part of the US Constitution. Imagine my surprise at that revelation!

Oh, and we have a secret constitution, called the Federalist Papers. With an intro written by **** Cheney, no doubt

The Dems (and others that support the constitution) simply wanted these guys that are being held charged in court, and given a fair trial, instead of being held indefinitely with no legal recourse.

He was tried and convicted. A definite victory for the Dems, and others that believe in constitutional rights.

The legal system can work, despite what the right wing wackos would have you believe.

PW2, do you know why he wasn't charged for the shoe bombing attempts? Because liberals seem to think the soldiers have to read terrorists their rights. Thats right soldiers. Liberals ideas of the role of the military and the aspects of terrorism they fight are downright frightening. His confession was thrown out because soldiers didn't read him his maranda rights. Can you imagine the 82nd airborne going into battle with Maranda rights being blasted in 15 different languages, and then being accused of torture cuz the speaker was too loud. How's the Kool-aid?

If it is such a victory for democrats why are they not trumpeting this from the mountain top. Why? Because it is a defeat.......... BTW it took only 1.5 days for the Jury to return the guilty verdict. Someone want to apologize to Ashcroft?

Yeah! No comments from the right. Only the left can launch thread after thread bashing what they don't like without being "desperate".

If we were all judged by the same standard (I know - that's not how those on the left like to do things on any level) this "desperate" phenomenom might be seen for what it is - the right to a conflicting opinion.

Richard Reed was the shoe bomber, and it seems to me he was charged and convicted.

Padilla was accused of plotting to bring a "dirty bomb", and was arrested by the FBI in the (Chicago?) airport. The military had nothing to do with it. I have no idea why he wasn't charged with that, but I suspect it had to do with having no evidence.

Nice try, though.

I think he wasn't charged and tried for treason because of this in the Constitution
Article III ; Section. 3. Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.
