Lurcher, and anyone else, lemme tell you a little story. When I was working at the Evinrude shop a guy brought in a boat with a 135hp motor which was less than a year old. The complaint was that it was running rough. Since I was very busy, the boat sat for several days till I got to it. But when I did get to it, I found that it was frozen up. Pulling the spark plugs, I found them full of rust. So, I tossed the plugs into the splashwell, put the hood back on, and shoved the boat back out into the yard, and went in and called the owner to tell him what I found.
Well, the next day I got a phone call from the owner and he was furious! He had came prowling around that night to look at the motor himself. He asserted that the reason that it was frozen was because I left the spark plugs out and moisture got in there. Of course he pointed out that it was running the day before he brought it in.
I wasn't too calm either, with this guy calling me everything in the book.
After my best peacemaking efforts I got him calmed down enough to get permission to tear into the motor to see what I could find. Turned out there was a big leak in the exhaust cover area, which allowed (salt) water to squirt into the cylinders.
So, once the truth was known, yes it was running the day before he brought it in. But it was ingesting salt water and that's why it was running rough, and why he brought it in.
I called the factory and got permission to replace the powerhead under warranty. Funny how the owner's attitude changed when he got a new motor, free. All of a sudden I was the greatest outboard mechanic in town.
IT IS possible that the motor you bought was running just before he listed it. Stuff happens. I'd say his offer to settle was reasonable.
