join class action suit?

some of you may remember my story of using dolphinite's new clear bottom paint. long story short, it was defective and my bottom became covered in growth. i lost approx 2 months boating time, spent several weeks repairing my hull, and repainted. boat is now fine. never recevied any recourse from the company, which admits the paint is defective (see www.dolphinte.com ). i've logged my complaints on their website, but have never received a single response. no emails or phone calls have been returned. i don't like the fact that dolphinite seems to be passing the blaim to the manufacturer of the paint (yet still refuses to even respond). my questions:<br /><br />1. i'm ready to send a certified letter to dolphinte asking for minor compensation to cover cost of the paint, my labor, and two months boating loss. is this a good first step?<br /><br />2. there is a class action suit (actually several) that has been filed. should i jump on the wagon?<br /><br />3. with numerous suits filed, if i don't follow choices 1 or 2, will my own suit be worth the trouble?<br /><br />thanks-

Please be mindful that class action suits can be very long winded. Never ending motions, discoveries, those who will wish to attach themselves to the original suit. Seems endless for the more complex suits.<br /><br />My Mother who was a member of the suit against DOW for the implant deal did indeed pass on in 1997 as a result of complications. That suit was active at the time of her death for several years. This is now six plus years or so later and the DOW CORNING Breast Implant Class Action Suit is still not settled.<br /><br />Mat, if time is not a factor, and you do not mind Trial Lawyers taking a huge bunch of $$$$$$$$$, consider joining. Be mindful that you may lose any recourse at a future time if you do accept an settlement.<br /><br />Remember the Tobacco Lawsuits of several years ago. Lawyers made a mint, litigants who "won"(state governments) blew the awards else ware, at least in Wisconsin.

If there are class action suits filed already, it is no wonder that you have not heard from the company. Their lawyers are probably keeping them from doing so - admission of guilt, paying out and then you joining a class action suit, etc. Lawyers do win, and they take time, but sometimes they do come in your favor. Just recieved a check last week for $4100 from a class action suit that was filed about 8 years ago. I had even forgotten about it!

yeah, i really don't have the time to go about it the right way. it was a real pain in the *** when i went through it, cost me some money and lots of labor, and lost time on the water. but time heals everything and i don't really care much about it. i still hate the company and feel wronged, definately deserve recourse, so i feel i need to do something. i guess joining one of the class action suits will be the easiest way.
