I can see both sides on this one. The borrower shoulda kept his mouth shut nd he'd be in the clear. He did a great thing but a hundred attaboys are wiped out by one "Oh crap"

I would think that saving lives outweighs all.

So where is the boat? It didn't just dissappear. 12K for a 1988 18'er is a little steep though too.

Yeah and that's what they wanted in adition to what they already received from their insurance company.
" In January, he received a letter from Mills noting that the Lyons had received less than half the replacement value of the boat and its motor from their insurance.

The letter asked Morice for $12,000 to "settle this matter." "

What this is a boat owner who just learned the difference between a replacement value and agreed value policy.

What a jackass.

Sorry guys, there are no excuses for this. It would take an extremely mean spirted a$$hole to ask for payment for comandeered boat used to rescue people.

I hope the judge in this case was rescued by a comandeered boat after the storm and the lawyer that took the case is left behind in the next one. :'(

Fat chance he will recover a dime. Boat insurance is based on the actual cash value of the boat. Insurance has indemnified him based on what he lost (ACV) that is all that the law recognizes in recovery. I would appear from this information that the insurance company holds the right to recovery (subrogation) and the only exposure to the boat owner might be his deductible.

Also, this is the type of claim that FEMA is designed to address, would recommend if he is serious he should contact them.

Boat insurance is based on the actual cash value of the boat.

My boat insurance is based on an agreed upon value; It could have been ACV or replacement value. It all depends on premium the insured is willing to pay.

There are some rather peculiar folks in this world and they do possess some rather peculiar ideas as it pertains to the value of human life.
