Legal definition of "Parking"

Are you legally considered to be parked if you are sitting in the drivers seat with the engine running?

Reason I asked is a cop told me I couldnt "park" in a striped off area near the mall entrance. I was in the car with engine running waiting for my wife who ran in for a second. I was completly out of the way of any traffic.

I always thought that if you were in the drivers seat with engine on, you arent parked. I know they can get you for DWI if you are "parked" like that.

I always took that to be "stopping & standing".....
In NY there are signs that say, 'No stopping or standing'
I think the cop is wrong......
Although they never are..... ​

I agree, but the signs specifically say don't do it......
Double & triple parking is a PITA too but that doesn't seem to stop anyone.....

The yellow stripes designate areas reserved for the use of emergency vehicles, including police, fire and ambulance.

In many places, occupying that space, even in an occupied and running vehicle, is the equivalent of parking.

How bad do you want to fight?

I just received a parking ticket for parking in the wrong zone at Phoenix Sky Harbor Airport.

Let me explain. My wife pulled into the wrong lane. She was there at exactly the same time I was. I opened the back door, threw in my stuff and noticed an officer writing my license number down. I talked to him and he said: "you're busted". "Got ya". I said I've been here ten seconds. He said: "don't matter"-got ya".

I got the ticket today. $267.00. No fighting, just pay it.

What a rip off.

DJ, I also got a ticket for being still for more than a few seconds at Sky Harbor. They are parking Nazis at that place. I did go to court and it was dismissed because the Nazi didn't show up. In fact, about half the "perps" in court that day walked because the citing officer didn't show. For $267 I'd go to court. I was only there about an hour.

My wife, basically, never stopped rolling. She never shifted out of drive.

I have to be careful, I have business with the City. Can't risk it. I have to pay. Integrity is numer one. It's BS. That guy came out of nowhere, already writing.

If I did fight it, it would be on the lack of signage. Any rookie, to Sky Harbor, can miss the signs since they are always blocked by the rental car buses, which are new. No new signs. Oh well!

And they all wear black for some reason.
Come out of a shop up there, you go one way. The way everyone else is walking.
You go against the grain and you get walked over.
That and all the cars must have perfect working horns or they trade them off.

The legal definition of "parked" used by the university my son goes to is:

"A parked vehicle is any stopped and unattended vehicle or any vehicle attended by a driver who refuses to move the vehicle."

You don't want to know how I know this ...............

The vehicle never really stopped, did not refuse to move and was attended-in gear.

No fight here, because of associations with the entity.. I'd swear this guy had a TSA uniform on. Moonlighting perhaps? That's "comforting" seeing as how much I fly.

I agree. If you stop in these areas I would stop just to let someone out and even at that I try not to pull into these areas myself just to drop somebody off. If they are only going to be in the store for a moment normally I would cruise the parking lot, although some areas down here are strict on that also. Parking in those areas is like parking in a handi cap parking spot without having a handi cap tag, I happen to be handi capped and have the certification and tag and it drives me nuts to see somebody park in a handi cap parking spot with just a regular tag and no hanger from the rear view.

I completely agree on the handicapped situation. I see it all day long. Jerks.

My situation was a bit different. Legal-no, but let's all get along as one human being to another. Not parking Nazi to unsuspecting citizen. What happened to civil discord when an officer told you, you were wrong and told you to move on? I did and and learned my lesson.

But I get a little "present" in the mail. Talk about gutless and ruthless.

They have mailed tickets and such to me too. In one case it was a year after I allegedly committed the offense. Was a felony ticket too,

I thought the definition of parking was something you did with your girl friend when you were a teenager.

I didnt get a ticket. She just asked me to move after she told me I coudnt park there. I told her I wasnt really parket but I can move. She didnt like that, i guess I shoud have never questioned her authority. Funny thing is, she wouldnt get out of my way to let me move, I had to reverse out.

It was in a striped area at the end of the row. I stopped there to get out of everyones way and if any emergency vehicle came, I could easily move.

Seems like the "law" is more interested in collecting people's hard-earned money these days than catching crooks. "Wildlife enforcement agents", too. Ya' ought to read their little magazine they put out.
