Oh no guys, this is just a scenario. Like a worst case situation. Basically I'm trying to figure out if I really need huge insurance limits on a little scooter that only weighs 229lbs, thus not really able to cause much damage in and of itself.

This is not a real situation. I just wanted to know what you guys ideas were on liability.

Whew! Had me concerned there WIF.

Well then you really need to heed my advise and have good medical coverage as people in cars seem to have a problem with the whole shareing the road thing

I can not tell you how many drivers that did not hit me because i got out of there way

Left turning people who di not see you are very common

Glad it wasn't a real situation. If it were a real situation, they would be able to determine the speeds of both vehicles involved, and would be able to eliminate the witness information (yours), which is widely known to be inaccurate (not yours specifically, witnesses in general :) ). Your scenario also needs specifics like vehicle types, number and placement of occupants, seatbelts/airbag deployment, weather conditions, day or night, etc.

Basically, if I were investigating this, you might not be at fault if you were able to pull out and accelerate to speed. Scooters are not known for blistering acceleration, so if you could see the vehicle, pull out, and make it to the posted speed limit, then the car that attempted to pull around should have been able to see you (again, depending on conditions) and could be at fault because he wasn't driving in a prudent manner.

You could get cited for reckless driving, and the driver of the car that swirved would probably get tapped for vehicular manslaughter (if he was drunk or the prosecutor was really pissed), reckless or at least inattentive driving (if he lived).

What you are forgetting is the civil suit that will follow. Hope you have a great lawyer... :)

It seems cheap, but dont forget we have a "winter discount". Though insured all year, you really only pay for 6 months.

Yeh, I didn't know they made them, (I knew about the 45 ACP great semi auto) , I have a 44 Mag, (way to big ta pack), n' the recoil would likely blow ya off the ol' scooter. JR

JR,
I was thinking the same thing. I'll bet I could run down his scooter long before he could aim a 45 mag over his shoulder (and still maintain control).

I called my insurance agent. I was paying 75 a year for a 10/20/10 policy on my scoot. For an additional dollar per year I was able to increase it to 100/300/25.

They didn't tell me this when they wrote the policy.
