Re: Mandatory court appearance for my 12 year old . . .

QC, i got to thinking more about this silly ordinance. i think it would be wise to actually get a copy of the ordinance. and look over it. what does it show in the ordinance, for fines and punishments. does the ordinance, say a court date is mandatory. etc. Some of these towns come up with things, that are completely unconstitutional, until someone challanges them.

JB's right in that it's the society we've grown into. (I don't agree with most everything else though).
It all seemed to go downhill when the Duke died.
It's a stupid law and the fine is excessive.
Someone probably got hurt, blamed it on the Park owner and sued. All it takes is one person/instance to make a law. It's the answer for everything - make a law. In the last neighborhood I lived in, there was a little County park which had swing sets, seesaw and the like. One kid got a splinter, mom wanted to own the County over it. The County removed all the equipment from the Park so it's now just a lawn.
Personally, I'd like to see as many laws repealed as are enacted...on a quota system or something. Lawmakers have a job to do like everyone else. They manage to think up some really stupid stuff sometimes (like bicycle helmets).
Personally, I think they should just put a warning sign disclaiming them from responsibility at the entrance "not responsible for injury". I think the parent should decide what is and what is not safe for their children (and only their children) not government (barring negligence of course).
Cops are another topic.
You have to respect the badge but not the person wearing it. I have working at a Police HQ building for the past 7 years and I can tell you that the behavior described here is not unusual. I could write the rest of the day citing example after example after example after example.
If a cop kicked my grandson, the cops would be on trial. Not because they kicked him, because after I go to the station and punch him in the nose, they would beat the crap out of me handcuffed in the cell and have a hard time explaining all the damage was done when I fell.
I would recommend you talk directly to whomever is in charge or their Internal Affairs as well as the Chief.

Yeah, TD, I have been wondering the same. I actually think the mandatory appearance thing is somehow a State deal regardless of the City origin. I had to go with my oldest for his first speeding ticket too, but that was State Vehicle Code. I will poke around the City's website as I have found them to be pretty complete. Someone mentioned Chino Hills, to clarify this happened in Chino which is a separately incorporated city. We contract with San Bernardino County Sheriff to Police our city, Chino's is a dedicated Police force. Chino PD . . .

BTW, the cops did tell him that he should skate in his own town's park . . . That reminds me of some kinda Wild West type comment. Seems unnecessary.

You can thank personal injury attorneys, at least in part, for this ordinance. One of the reasons why, what seems to be an excessive law gets enacted, is that municipalities get sued frequently. On one hand, they would like to provide recreational opportunities for kids, on the other hand, the parents of those kids are a great deal more likely to sue these days, if the kid gets hurt. That being the case, municipalities try to reduce risk by passing laws to make the kids wear lots of protective gear.

That said, $77 for not wearing knee pads seems excessive. What is even more annoying is that most of that fine is probably for court costs and the bunch of other charges that municipalities build into their fines. I wouldn't be surprised if the actual fine is only about $20. In this fact, the other annoying part of "modern life" is apparent - that municipalities use ordinaces & fines as a revenue source.

OK . . . Chino Municipal Code:

10.24.080 Regulations applicable to the use of skateboard/skating areas.
C. Each person using any skateboard/skating area must wear a shirt and proper safety equipment including a helmet, elbow pads and kneepads. All such safety equipment must be functional and protective, properly sized and designed for skating or skateboarding purposes.
10.24.120 Penalty for violation.
A. Any person who violates any of the provisions of this chapter, with the exception of Section 10.24.090, shall be guilty of an infraction punishable pursuant to Section 1.12(B) of this code.
1.12.010 Violation--Penalty.
B. Whenever in this code or in any other ordinance of the city any act is prohibited or is made or declared to be unlawful or an offense, or the doing of any act is required, or the failure to do any act is declared to be unlawful, and the act or omission is declared to be an infraction, or is not declared to be either a misdemeanor or an infraction, the violation of any such provision of this code or any other ordinance of the city shall be an infraction and shall be punishable by a fine not to exceed fifty dollars for the first violation.
I am guessing the additional $27 is court fees . . . Annnnnd, I am guessing the mandatory appearance is State. I'll see if I can find that.

I would show up in court with my son, both of us dressed head to toe in safety equipment. It is truly an unsafe world out there... You never know when an owie or bo-bo will strike next.
