Just for information sake. When you (the op) took the pic it automatically becomes copyrighted. The only way it can legally be used is by permission. Let the other scammer know he is using a copyrighted pic.

Hmm, I think I am going to get beat up for this next comment, I think when you post a picture in a public forum (Craigslist would be one) the picture becomes public domain and can be used by anyone unless it is copy righted (registered).

Under US law copyright is automatic.

There aren't enough copyright cops in the world to go after all those that misuse ?ed photos. When they do it's for gross misuse, not onesies, twosies. So a threat to turn in a CL poster using one is basically empty.

You are right but I was just posting the fact that you don't have to register or anything to have a copyright on a picture.

Sometimes I don't understand why there are delays in posts showing. I didn't an hour after you, Thump. Your post wasn't there when I started the reply and was there I after I submitted.

Anyway - Legality and reality are two different things. I know all these are automatically copyrighted, but the thief doesn't care. All he wants is your money sent to Nigeria or where ever, as long as he gets every penny he can.

What the PO should have done is driven the two hours or if he has a friend closer, and visit the "seller" of his boat. I bet he won't be available to show it. What leads me to that deduction? "he said he needed the picture to sell the same boat for someone out of town" The same boat was in the OPs backyard.

But if it's brought to the spammers attention that what he is doing is illegal that in itself might get the add taken down.

I had a similar experience. I had my 27' IMP photos posted on the net. In my random CL ad searching I found a guy selling the same year IMP. I clicked the ad and he had used my cabin photos. I wasn't concerned as it didn't affect any sale I was making, and even emailed and let him know they were mine as good luck with the sale. Never got a response.

He was either to lazy, or your boat looks better that the actual one he has. Or both!

Even if you took it to court on principal. The judge will ask how much money you lost because he used your photo. Zero?
That is what you would get if you won the case.

Just let it go and live your life in peace.

Re: My boat pic on CL stolen

I saw an ad on kijiji (Canadian CL), the ad was for an 1968 shelby mustang. The ad show this pristine condition car for 5k or best offer. The ad reported it was her late husband car and that she did not really know what the value of the car was. I think the scam was to take deposits on the car and of course never deliver. I guess the idea here is to take advantage of greed on both sides, seller and buyer.

the undervalued item scam will have you paying shipping, deposits, etc. and there is no car, boat, etc. With boats you look for the registration numbers to be gone from the hull, or if they are there, inconsistent with the state. being a Navy town, we get lots of "navy wife with deployed husband" and "being deployed overseas next week have to sell boat". Often the seller says he's local but the boat is at his parents' house in Ohio. Says the Navy will ship it but I have to send him $$ to cover it.

Say a boat is advertised in my home town; I get in touch and want to come see it. they say, sorry, it's at my parents's house in Cleveland. I say, we're in luck I'm going there Tuesday for business; what's the address? Mysterious silence....

Re: My boat pic on CL stolen

Turns out that the guy has a 01 Bayliner 2452 like mine for sale. He posted an add on SF Bay Area CL with his own pictures. So he cussed me out for telling him not to use my picture. Thanks
